take the appointment already... and with the first appointment itself, get the xray done as well so as not to waste time after tb skin result....

luckily for me, the RFE was not medical.....

My wife just got her H4 stamping done 4 days back (her I-485 has been applied as my dependent).
I had the same question, researched over internet and most of the places it says - "per lawyer, i-485 is adjustment of status and not immigration visa petition, so you should write- 'no' "----

BUT--

at one post, the person said that they got response from VFS office to write 'yes'-

I sent email to VFS but didn't receive response-- so I did put 'YES' for my wife-- and put 'SPOUSE VIA EMPLOYER'.
Don't know whether this is correct or not, but my wife got stamping done without any problem (this was not asked by consular, but if he had asked, then it would have been easier to explain that i-485 is applied as dependent)

So, i would say-- go ahead and put 'YES'

Based on what I had read across all the immigration forums when my family was planning to go to India, Raja2006 is correct.
You should have approved AP before leaving if one plan to come back on that AP. Though if you have H1/H4, then AP is not required.

The name on my 485 application, passport and birth certificate are all same.

But birth certificate was registered in 2007, and also, it lists only father's name.

Following are the documents that i have.
1) I am planning to get the affadavit from father, mother and a cousin.
2) I have pan card with father's name.
3) My passport first/last pages have date of birth / fathers and mothers name.
4) 10th marksheet lists date of birth and only father's name.

a)Will these above documents be sufficient?
b) how do you get birth certificate from embassy? will it reach in time?
c) Also, is below sample affadavit looks okay?

Did your RFE has same wording as mine?

Also, what should affadavit contain? Any link for sample affadavit? Should it be on plain paper with duly notarized ? or any special government paper.... stamp paper etc?

and another bit of addition while researching more similar to this type of RFE....

both mine and my wife's birth certifacate were registered in 2007, i.e. when we needed to file I-485, we got our parents to run around for us to get the birth certificates....

reading at some other posts doing 'search' on this site, it looks like, this also could be the reason for the RFE.

But still would appreciate a response and also, then this thread can serve as one stop help for all RFE.

My birth certificate lists only my father's name.
My wife's birth certificate lists both her father and mothers name.
Though both got exactly the same birth related RFE.

I got email that RFE is sent on 03-APR. (both my and spouse)
On 06-Apr, there was soft LUD.
Today, 10-APR, attorney received RFE and faxed. It shows the date of RFE as 06-APR (with last date for response of 06-May).

Here are the word to word copy of my RFE. (thank god, its not medical related, as my wife is on vacation to India). Please help how should I respond.

My RFE- (prinipal applicant)

1) Please submit the oldest available evidence which establishes your birth and parentage. This evidence may include, but is not limited to:
a. Hospital birth records which name the child and both parents.
b. Medical records which name the child and both parents.
c. School records which name the child and both parents.
d. Census records which name the child and both parents.
e. Religious records in the form of a certificate under the seal of the organization where the baptism, dedication, presentation or comparable rit occurred following the birth, showing the date and place of the child's birth, the date of the religious ceremony, and the names of the child's parents.

2) .... blah .. blah... for basically 'employment verification letter' ---- THIS IS STRAIGHFORWARD ONE TO GET.... SO NO PROBLEM.

My wife also got the same #1 RFE and another one regarding evidence for marriage certificate etc.... will post in another post to avoid confusion.

For the birth related, the documents that I had submitted was 'birth certificate' in hindi and in english for both spouse and me.

Did anyone got this type of RFE?
What documents should I try to get? Should the affadavits from parents be also included? or the old school marksheets etc, though with only father's name? how old is the oldest that should be okay?

Please please help.

Topic: Form I-693 - USCIS civil surgeon list in India ?

I heard that there are approved USCIS civil surgeon in India also who does the medicals there (basically for people applying for family visa from india itself).

My spouse is on vacation to India and we got RFE (not sure what yet, but probably redo medicals). So I was wondering if anyone knows where to find the list of doctors in India (specifically Mumbai) who can do the medicals and fill I-693.

Also, is it really valid to get it from there? Anyone had similar exprience?

Any help is appreciated.

I also got RFE on 3-APR-09 for both my I-485 and my spouse(dependent). Don't know yet what the RFE is about? Will update the profile and add details when I get to know about RFE.

How much time do we have to respond to RFE?
I heard one month. Is one month from the date RFE was generated (3-APR) or the date the lawyer will receive the application? In little sticky situation as my wife is in India on vacation with scheduled return on 4-May. Any help will be appreciated.
