Topic: no LUD on my wife but recent one in mine?

My wife and I concurrently applied for AOS in 5/21/07. We both went for fingerprint and got an LUD after that. We both have now the EAD and we got the update from CRIS about it. On my 485 I got an LUD from 7/28 but wy wife did not get any. LAst one on her case was after finger printing. Should I be worried and call to speak to IO or just wait as this may be one name check cleared and the other one still pending.

Appreciate your advice.

Last approval from Texas center posted is from 7/27, I hope this is not a major slow down. All latest approvals are coming from Nebraska.

Topic: Business on EAD

I think you will have to ask a lwayer if the question is to continue to work with the H1B and do a part time on top. I know that if you change jobs with your EAD, you are no longer considered to be an H1B. You become someone on pending 485. If 485 is approved no issues but if not approved then you will have to leave the US as you are no longer under the H1B that you have valid until 2009. That will allow you to stay here and keep working on whatever issue came up with the 485 and reapply.

Topic: Medical Test Tb + ve

To clarify on some of your question:

- TB skin test is to determine if you have been "exposed" to the bacteria that causes Tuberculosis. If the test is positive it means you have and you are at risk for developing the disease itself which in most cases it is in the lungs, like a pneumonia. Some people who got the BCG vaccine may be positive but anyone who got it when they were newborn or very early is not expected to have a positive PPD (tuberculin skin test). If BCG was given at older age then it may be.
- Once your PPD is positive then it is said you have at least LATENT Tuberculosis and it is indicated you get an X-Ray to see if there is anything in the lungs that could be conistent with ACTIVE lung tuberculosis. If it is positive, they have to evaluate you for the bacteria by getting samples of sputum. They need at least 3 negative to say maybe it is NOT tuberculosis.
- Because tuberculosis is contagious then Health department is informed (it is a public health issue) and they go to your house to make sure you do everything is needed and get treatment if you have the diseas in the lungs. Also they need to test close contacts because they are at risk and may get it too.
- If you have a +PPD and normal X-ray, they may suggest you take a pill for 9 months to preventthe infection from getting into your lungs. That is really important if you know you have a previous NEGATIVE. Otherwise you may have been positive for years and no need to give you the medications.

According to what I discussed with my lawyer, once USCIS gets your application, they start processing (fingerprint, name check, etc)...If evrything goes thru, then you get reccomended for approval and at that time a visa number is requested to Dept of State. Numbers are not requested prior to approval because it will expire in 7 days and get reassigned to some other case.
As it stands now, all of those Visa numbers were requested and question is if any of us are in that group.... Processing of documents will continue but if you reach approval and no new numbers are released then you will be on hold until October when new numbers become available. Two things that can happen is that we are on the group of 60K numbers requested, or some of those numbers get reassigned if process does not go thru in a particular case then somoene else gets it. If niether of those two happen, then it will be wait till October for new releases and who know how many request there will be in October...they may even have a similar situation as it happened with H1B that all avalabele numbers were gone in just a few days....that is just a thought, hope it does not become a reality.

They will process them, that does not mean they will have numbers to approve and give GC once process is completed and reccomended for approval. At least that is what I understand.

My PD is August 2003 (When I filed for labor) and I mailed the 485 in May, it was received at the Texas center on May 21st. I asked my lawyer about it and this was the answer:
"We have to wait for your case to be reviewed by an officer and for the priority date on the case to be reached. They can review it priot to the date being current. However, they will not issue a decision before the priority date is available and current"

I guess that means if your case PD is within the number allowed you may get your GC otherwise it will be on hold until new numers released in October.

If someone understands this differently, let us know.
