Topic: Canada Landing and H1B Stamping/AVR

I crossed over for my landing this March in the same situation.
I had an expired visa and a valid H1.

There is a contiguous states rule that states that you can go to Canada or Mexico and return back within 30 days provided you are not going to visit a US consulate there.

My landing and return went without a hitch.

The US side wil look at the Canada visa, the H1 papers and the passports. You explain to them that you are going to Canada for completing Canadian immigration.

Same thing while coming back.

No hassles, I know of some more cases like that.

The bigger question is what will you do in Canada?
Do you have a job offer?

Just one more point though.
Lets forget about the whole business of Mr. Kumar staying outside Canada for the moment.
If he stays the last two years out of his 5 year period in Canada will he have to stay for one more year to be eligible for citizenship.Correct?

Questions for Guru Indianmunda:

1) Does the two year period of stay to retain PR status count towards the three year period required to be eligible for citizenship? This means that you could be eligible for citizenship in a max. of 6 years if you stretch your timelines to the max.?I presume it is but would like your opininon.

2) Theoretically consider this scenario:

Canadian company A enters into a contract with US company B to provide resources for consulting. Mr. Kumar who is currently in H1 in USA and a PR in Canada gets hired by company A and leased out to company B who places him at a client site. Mr. kumar does not physically relocate to Canada

Can he maintain his PR status?
Will the period he is on contract in USA get counted towards citizenship?
Are there additional qualifying for Canadian company A to meet or for Mr. Kumar to meet in order to take advantage of this situation?

3) If Mr. Kumar above also has a GC going in USA does that get impacted?

I have not anyone in Canada saying that their life is miserable, even though to me it felt like the cost of living was pretty high, people generally tell me it is much less stressful life than here.

Again this is all very very personal and subjective to your individual status in life.

The GC process for Canadia citizens might be better but again is entirely dependent on your getting job and that means H1 and that as you know is a lottery now. Much playing lotto.

Workopolis - the best
Craigslist too can be useful
Yahoo Canada has a jobsite that is good too.
There are others for IT jobs that I know and you can always google for recruiters in Canada. People like Robert Half are there in Canada.
The other good place to network is on Linkedin. You can search for jobs there too.

Hello everyone,
I have been missing in action for a while.
Yes we landed . Went by road to Toronto. It was really very very easy and simple.
We crossed over at the Buffalo border on a weekend. Immigration posts at various are open 24/7 and so you can and at any time even on a Sunday. Google Canada border services orhanization and you will get the website. Very useful for landing info.

The guy at the checkpost looked at our passports and asked us to proceed to the Immigration and customs. He joked with us saying we would definitely like Canada better.

At the immigration office the lady took our forms and passports. These forms were the ones received in mail - one for each family member. Although it was mentioned that we needed to get our photographs (getting them was the most painful part) but she did not ask for them at all. She asked us we would be moving now and I said no we need to wrap up some pending assignments and most importantly we will move after kids school term is over.

That is all . At the customs then we were asked for the List of Goods to follow. We had a sketchy list and found out that once it is stamped anything else we bring will be taxed a new item and then we will have to pay customs duty. So we hurriedly addded some more items that he only suggested.

We were done in like 30 minutes but just hung on asking them how to go to Niagara Falls on the Candian life.
Everything was very welcoming.
We then proceeded to my friends place who had suggested that we stay and apply for our Social Insurance cards as well. This has to be done at a local employment center. We went Monday and completed that in another like 30 minutes. again very organized.

As I write the SIN cards have been received by my friend whose address I had given.
So far my experience with the Canadian authorities has been the exact opposite of dealing with the US clerks.

i did not visit the forum for sometime so missed your post.
I am still in the USA but am going to land in Canada very soon.
To make my final decision of relocating it will be great to have your experiences of living in Canada.

Topic: Is there anybody working at the Atlanta Center this year?

Guys lets try and extrapolate this given that over 300,000 applications were receievd during "visagate" last year.
What do you think will be the impact and projected delays on various stages (PERM, I-140, I-485, EAD).

We are clearly seeing PERM extending beyond 180 days, possibly touches a year?
What about the other stages and so an assessment of the total you expect this will take?

We can then validate this and try and see if it is worthwhile to pursue this any more or look at alternatives (Canada, India)

Topic: My perm file on 10/31/2007 and audit response time on 12/28/2007.

In a very unfortunate way I get some solace seeing these messages. I too am in the same boat.
PERM applied in EB2 on May 6.
Received Audit in Oct 2007 and replied back in 10 days.
Waiting since.
Lawyer says Atlanta is taking over 6-8 months for EB2 cases a little less for EB3.
Rajiv Khanna says the same.

Appreciate if we could constantly update each other and keep company.
