Topic: Did you know back then (when you started your GC process)

There is a very thin slice of immigration law where I am confident that I am better than majority of the ordinary immigration lawyers.

It is also true that in a few months to years this chamaleon named immigration-law will change so much that I will lose my definitive edge and undertanding.

Yup, all that I put in my message above were by name mentioned in the RFE: tax returns (1040 and 1040NR-EZ with 8833 and 1042-S, all mentioned by form name/number), paystubs, 1099s, W2s and all... this IO has some motive I am sure, but he/she will get all of them so no worries here... I'm sure it will be a befitting proverbial slap in the face...

Some IO in NSC is being quite over-zealous lately. I got an RFE on I-485 demanding:
1) all tax returns
2) all paystubs
3) all W2s
4) all 1099s

from 2001~2006 (also 2007 paystubs!). All because IO failed to add my wife's and my W2 for 2003 to match the figure in the tax form. Talk about "guilty until proven otherwise" (yeah, thats "otherwise" and not "innocent" because my country of origin makes me "unforgiven" even without any sins!!!)...

well to IOs surprise I am a habitual hoarder of paystubs and he will be inundated with the photo-copies of them all, along with another ton of tax papers... lol

Topic: I-140 and I-485 trackers

Nope, it looks great the way it is.

It serves as a powerful tool to cross-examine how I140 approvals affect the I485 trends and how well "premium" and "regular" I140s affect the I485 adjudications. Although the information in seperate trackers be there but it would not be possible to see the progression trends of who got I140 and how the I485s followed them.

Ofcourse you can also put redundant information in the I140 and I485 seperate trackers which would have overlap with the concurrent tracker under "concurrent" filing pull-down-menu. That way both cross-examination trends and individual filing trends would be easy to follow.

Topic: Processing dates for I-140 and I-485 for Nebraska

Do a bit of analysis and you will see:
1) a lot of pending I140s with few regular approvals and a lot premium approvals so the average is shifting backwards.
2) a lot of pending I485s with few regular I140 based I485 approvals and a lot premium based approvals thus average moving forward, as USCIS "reasons" that why should I485 dates be "penalized" for a pending I140.

This is a convoluted way of trying to maintain some "close to six months" adjudication promise. If you have interest in mathematics, what you are seeing is "bimodal distribution" as opposed to "gausian distribution" because of premium-vs-regular approval trends.

Interestingly enough, theoratically if you have 30 days past your pending I485 date versus "processing date" you can ask why your case is delayed (knowing full well that its because of I140) and I can bet my life that they will say that its due to "Name Check" when in reality its just because of regular I140 delay.

Observe the absolute massacre thats happening in Nebraska... 6+ months wait for regular I140 and even that is coming to a standstill... Maybe they are reshuffling the workload b/w NSC and TSC... or at least I hope so... Premium is the only thing that is moving, guess money talks!

Topic: Decoding the Processing Trends

Texas I140s (regular) are getting approved in 20~30 days. while I485s in 50~80 days. The online processing times are incorrect because they have a mandated 6 months delay allowed for I140s (regular) and I485s and 3 months for I765s and I131s. This I noted by analyzing a large chunk of relavent data for I140s (regular) and I485s of EB2s, note that processing times do not fall less than 6 months in the bulletin despite the fact that they are PHYSICALLY lower than 6months in processing.

Also note that whichever application is taking longer than 6 months is shown correctly (I485s from nebraska are indeed adjudicated in March06 (till this writing) and nothing newer!)

This way they make themselves a nice little cover period of 6 months in which they do not have to answer anyone, kinda like a damper.
