I watched with so much interest yesterday's presidential elections; and wished that after 12 years of living/working in the USA I had had the opportunity to participate in such an event; this day
however brought me good news and finally I saw my I-140 case online indicating that it has been approved on Nov-04-2008.

Topic: I-9 HR using EAD
Human Resources department contacted me when I received approval for my H1b extension ( Mar2008-Mar2009) to enter the info on their I-9 records. Recently I received a 2 yr extension for my EAD (Aug2008-Aug2010) and HR called in asking me to update the I-9; I pointed out that I believed that since my work with the company was authorized by my H1 status they did not need to use EAD. Will entering the EAD info in I-9 form invalidate my H1 status ? |

MY PD is Aug 2001 - MY LC was captive of a Backlog Center until it finally got approved last year. I filed I-140/I-485 concurrently in Aug2007 - Still waiting.
This has been an exercise in impermanence/permanence, tolerance and patience needed to make sense of the non-sensical, absurd, and convoluted rules of the USCIS. |

A colleague received his Green plastic today; his I-140/I-485 were filed concurrently in Feb-2008 category EB2 PD Mar 2003 ROW. He received his I-140 approval notice Jun-09; to his surprise today he got in the mail his Green card. He checked his I-485 status and it indicated approval and card production initiated on Jun-13th. did not know card production/mailing could ttake just one week - almost simultaneous I-140, I-485 approval!!! |
Topic: EAD approved - H1 Extension?
I was contacted by company HR to extend my H1 and family H4's for one year. They told me because my LC was filed more than 365 before my H1 6yr expiration I can get this extension; they also claim that later on if my I-140 is approved they could get an H1 3yr extension; but I thought for the 3yr option the visa number should not be available which is not my case.
Doesn''t this extension complicates my situation a little bit ? My wife would not get the H4 extension since she started working using her EAD, and now my son who is 17 yr wants to get a driver's license. Should I go ahead and get the extension or otherwise work with my EAD ? |
