Has anyone received the actual approval notice (I797 notice of action)? Does it go to the attorney's office, or the applicant gets it in mail? I received Welcome notice (I797C), which means courtesy copy

wouldn't be approval notice will be same as courtesy copy? I think it should be exact same. Even copy we received is courtesy copy but it says about approval in the description.

My lawyer said its same - I think its better to have the I797 with us just to make sure we have all the paperwork with us. After all, applicant is responsible for I485 process, not the employer. In my case, attorney hasn't received approval notice yet. Has anyone received it yet?

I have the same concern...do you have the address to where the info should be sent?



The address is normally on the letterhead which you may have received with the ITIN. As far as I remember, the address depends on the state you reside. Also, if the ITIN was issued long time back (say, few years) its possible that the mailing address may have changed.
In case of my wife, we visited the local IRS office and showed them the SSN and ITIN cards. The lady took SSN card's photocopy and told us that the SSN has been 'recorded' in their system, and we should start using SSN# from now on. She took away the original ITIN card and gave us its photocopy. We used her SSN in the latest tax return.
In short, please make sure that the SSN is in IRS's database before returning the ITIN.

Should this letter be sent to Michael Aytes too? He is the one who wrote the name check memo, he should know if name check procedure is being implemented, especially @ TSC. I had wrote a similar letter, wanted to send it, but the attorney is resisting, haven't sent it yet...

Topic: Namecheck not clear..please help

I had Infopass twice in past 2 months, both times the IO mentioned that clearing of name check should not matter during adjudication, if the case is pending > 180days. This was @ San Jose, CA office.
But looking at comments in this forum, looks like TSC is following its own interpretation of the memos. Nowhere in the April 02 memo its mentioned that it supersedes February memo...
I wish they follow the February memo and clear old pending cases fast.

Another thing is,regardless of low-hanging fruit method, if your case is appprovable, there is no reason for USCIS to hold your application back.

In most of the times we are all accusing that the CSRs and/or IO officers dont know what they are talking. We have seen many posts stating that IO's on the phone said they could not verify if the NC is cleared or not.

So, if your PD is current and your RD is before Jul 2007 and I-140 is approved, then there is a change that the NC is not cleared. Other than this, if you see any other reasons, please share it.

------- I wish life was that simple. The first thing USCIS does is NOT to follow their own rules and the law. They are supposed to process earlier priority dates, most of them are approvable. They are not doing it right now. Also, I doubt if they are following 180-day rule for namechecks - we read conflicting info about this all the time. All paper files are stored in massive warehouses, as shown in latest Ombudsman's report (notorious Fig 12). Even if a case is approvable, all the paperwork must be on IOs desk to adjudicate a case, brought from the warehouse - who knows how long that takes.

The second issue is their productivity and the IOs themselves knowing and interpreting the law and internal memorandums correctly.

In short, too many unknowns... May God help us...

My PD is 12/30/05 and RD of 07/26/2007 @ TSC. They have approved cases with both PD and RD later than mine. I wonder if I missed the boat of low-hanging-fruits?

----- I think the process of picking low-hanging-fruit may be random. But if they keep processing '05, '06 cases your spot may be in the next boat :-)

I don't think its randomness - they are clearly following low-hanging-fruit scheme to consume visa numbers for this year. The other reason may be to clear out as many 2005, 2006 cases before the next one or two visa bulletins, because there are more chances of dates moving backwards. Then, they can spend time on PDs for 2004 and earlier, for the rest of next year. Thats my guess.
