Topic: Help needed - EAD Fee Payment Rejected due to Insufficient Funds and Case Placed in Suspense

Guru's Please help.

Here's my friend situation.

F1 Student - applied for EAD on Feb 2007 and approved on Jun 20 2007.
EAD was sent back by USPS due to undelieverable.
Updated address so that they can resend but it took long time and no of phone calls to uscis but no luck.
So applied using Lost/Stolen card method and posted the application on Dec 17 2007.
but on Dec 22 2007, EAD was re-sent to the updated address but by the time this LOST/Stolen applciation reached USCIS,
So, my friend placed a stop payment on the check thinking that USCIS atuomatically rejects this extra application and additionally he sent a withdrawl letter saying that not to process this new application.

But now the case status says.
Fee Payment Rejected due to Insufficient Funds and Case Placed in Suspense
On January 17, 2008, we suspended processing of this I765, APPLICATION FOR EMPLOYMENT AUTHORIZATION, because the fee payment was returned by the bank due to insufficient funds. We have sent you a check deficiency notice in the mail which explains the steps you must take to resume processing of your case. If you do not receive this notice within 30 days from January 17, 2008, please call customer service at 1-800-375-5283 for further assistance.


He also received a check deficiency notice in the mail saying the following.
THIS IS AN INFORMATIONAL NOTICE ONLY. THIS IS NOT AN INVOICE
We have stopped processing this application or petiotion because the check or money order submiited as payment was returned by the bank.
You, or the person who wrote the check will receive an invoice from the INS Debt Management Center. The invoice show why the payment was returned, what you owe, including any penalties, and where to send your payment.
We will take no further action on your applciation until the filing fee, plus all penalities are paid, in full. However, if we do nto recieve payment in full with in 14 days, then:
1. Your application will automatically be rejected as not properly filed.
2. Although the application will be rejected, the debt to the United States of America will still be due and the Government may take legal action to collect the debt.
3. In addition, once the application will be rejected, If you want to continue to seek the benefit, you will have to start over and re-file an entirely new application and submit a new filing fee. However, refiling will not eliminate the outstanding debt for the prior application.

If an invoice is not recieved within 14 days, or if you have questions about payment, call 802-288-7600.


Please help me in this regard.

As I received my earlier approved EAD, I do not want to continue with application and at the same time I dont want get into bad debt trouble to USCIS/INS. what could be my best bet in this regard.

Good news for all of you guys, I had the same situation, My I-140 got a recent LUD of 11/25/07 and My GC just got approved....

May be your's all will be on the way.
