We oped a SR today.
When we called, The customer suppor person said that the processing time is Aug 02 and asked us to open SR:

Later we got the following response in mail:

The processing date on the Processing Time Sheet is incorrect for your category of I-140 petition. According to our records, the correct processing time for your category is May 2007. Since your case was received on 7/2/07, your case is still within processing time. You can check future status of your case on the website, www.uscis.gov, for it will be updated when there is an action on your case. We apologize for any inconvenience.

They are saying whatever processing times they have published online is wrong.

THe memo says:

"Form I-140 Petition Must be Approved Prior to a FAVORABLE DETERMINATION of a ยง106(c) AC21 portability request."



It does NOT say:

"Form I-140 Petition Must be Approved prior to AC21 porability request"

You can change the job, when 140 is pending ( 485 > 180 days). If the previous empoyer agrees to reply RFEs, you r safe.

What the memo says is:

You can apply for the AC21 with a pending 140. But the AC 21 is considered valid only after the approval of 140.
If your 140 is rejected after applying Ac21, your AC21 will also be invalidated.

My point of view..

They are shooting in their own leg by not approving 140s.

If they approve my 140, I will buy a home, there may be atlest another 300000 GC waiters be doing the same. This might turnaround the housing market and boost the economy.

The longer they take to approve my 140, The longer it will take for the economy to turnaround.

Meanwhile I will invest try to invest somewhere. USCIS it is your call now., hurry before me spend the 20%(for bay area) down payment.

They are taking two months to move 10 days in processing time. If you look at the processing time trend, it wont move for one month and the next month it will move apprx. 10 days
