If the priority date became current today , due to delayed USCIS processing and thus underutilization of visa numbers, some have predicted that within a few months as many as 500,000 to 750,000 individuals now residing in the United States under a temporary worker visa could apply for a green card. Additionally, DOL’s recent backlog elimination efforts, scheduled to be completed by September 30, 2007, are predicted to add 70,000 or more approved labor certifications yielding as many as 170,000 additional green card applications. As USCIS begins to complete these applications and request visa numbers from DOS, the 140,000 statutorily authorized visa numbers will be used. DOS then will be required to retrogress priority dates. Consequently, most applicants in this scenario will find themselves trapped where as they anticipated timely receipt of a green card, their wait exceeds seven or more years. In addition, all future employment-based green card applicants effectively would be barred from applying for many years.




-- That's mean tons of people will file I-485 + EAD + AP and then they can work legally. For USCIS, it means millions income, isn't it?

TSC/NSC IO cannot handle current cases on hand and they still make the all EBs current to accept thousands of cases. It seems they want to collect more money from fees during the following months. Interesting.

If new petitions get background check clear earlier than us, they will get GC a lot faster. It explains why some petitions filed in Feb or Mar 2007 got approval while the processing time stalled in Sep/Oct 2006. More petitions might make the chance higher.

I saw a post said USCIS have contract people to pull out the cases whose background check is clear into a queue. It is neither RD nor RD. Besides, many people have filed their cases before the PD retrogressed. Their cases should be approved as soon as the PD is current since their background check began much earlier. I guess their RD also make the processing time backward.

In your example, I think it depends on who has better luck to get background check clear earlier. Older RD only means background check begins earlier but not guarantee get GC sooner.

It's not the first time NSC processing time moves back for a month. We should get used to it because flood gate opens in May and Jun.

Topic: No FP in NSC?

Checking the cases at both Concurrent I-140/I-485 and I-485 tracker, people who filed their I-485 at the end of January didn't get any FP notice. Those applications going to TSC are lucky and they got FP notice within 1 week. It seems hard to predict the trend of NSC.

Topic: Receipt Time

You can check if they deposit your check. If you see a number begins with LIN or SRC, that's your receipt number and you can go check the LUD on USCIS website.
