HiGc is somewhat correct...but why dont we see denials or questions being raised on w-2 for such employees...?
maybe they stay on bench for 2 months, then find some project with higher billing to compensate for it?..so the overall
income still beats labor specification

software service companies (bodyshops, as they are called) have the concept of "bench" where perhaps the initial contract (not linked to the h1b petition) explains the salary issue while on bench and the regular payment/salary deal. from what i have heard, the obvious advantage is that when u dont have a project they wont revoke your h1 which most other companies do after a month or so, thereby allowing you to look for a project in the market and also have your gc process continue without the risk of abrupt termination.
i dont and have never worked for one of these, so this is just what i have "heard"....i dont have any personal knowledge or opinion about legality of such situations. since you were jobless for 5 months and your h1 was still kept valid, you were at an advantage due to this policy.

can you renew DL with just the approved EAD card (issued for 2 yrs, not being used) while h1 renewal is pending? anyone done this in ny? what is the actual exp date of the license? the one in bold red about being a temporary visitor or the dob? thanks a bunch.

only a lawyer can exactly interpret the wording in the contract, but from what it reads you don't owe them anything until
you obtain your gc, and there does not appear to be a clause of what will happen if you leave WHILE application is being processed.
striking a deft deal with them for the 5k in exchange for not revoking the I-140 (ON PAPER) would be a wise choice, but you should take a 2nd opinion of a qualified professional on the contract terms (as stated).

Topic: painful situation


My last post on the topic here. I work in a big organization were 90% of the employees are females. And my knowledge is coming from what I see and what other females have taught me. I spoke with my close female friend today and here is what she said: "It's definetely harder to work with females then with males. We, females, take everything personally and our decisions are based on our emotions". That's end of discussion here. I wish the very best to the author of the topic.



i second that....nothing sexist about it, it is what it is....everyone knows who gets driven by emotion and commits the most vicious, sly, contrived, heart-rending-hateful/spiteful acts "behind" the scenes, irrespective of location and situation

it is a h1b visa applied by a not-for-profit org like a university for you, and is not subject to the 65k annual h1b cap. it is therefore cap exempt, all other things/rules are the same except portability as for a regular h1b. however, bear in mind that a "cap exempt h1b" cannot be transferred to a "regular h1b"..in other words, if you decide to join the industry/company at a later date they will have to apply for a new h1 subject to cap for you, the cap exempt h1 will not be transferred.



Here we go, I am enjoying exactly this situation. H1B exempt, low paying job, some great job offers from industry that I am reluctant to take because I do not want to abandon my GC application or take a risk of working on EAD with a new employer and getting out of status if GC is denied for some stupid reason.
