What is your wife's visa status? Is she on H-1 or H-4?

The moment your I-485 is approved, you're no longer on H-1 status. So if your wife is on H-4, then her H-4 status is not valid any more. If your wife is on an independent H-1 that is valid, then she should be ok.

Topic: Switching employers in 7th year of H-1?

As long as your H-1B is valid, you can switch to another employer, have that employer file your H-1 transfer, and then file PERM at the same time. Should work, depending on for how long your H-1B is still valid. Should be valid for at least couple of months.

Topic: Can someone explain priority date?

Even after your I-485 is filed, the priority date of your application is important. Your priority date needs to be current for your I-485 to be approved. For example, if you file your I-485 now (when all categories are current), then 2 months later, your category gets retrogressed to some time before your PD, then your I-485 will not be approved until the priority dates being processed move forward again, beyond your PD. Basically, at the time a visa number is issued for your application, your PD needs to be current.

Being current as of today enables you to apply for I-485, get EAD, AP, but does not guarantee that you will be issued an I-485 in 6 months. The retrogression can still affect you.

Of course, that should be ok. Is your 6 yrs on H-1 already over? In any case, it might be sensible to include a receipt notice from USCIS that your H-1 extension is in process. Isn't your lawyer already taking care of this?

I remember asking my company lawyer that if my wife (who is on H-1 right now) quits, then can I still file my I-485? The lawyer said yes, they can file an H-4 for my wife at the same time that they file I-485. The two are independent. So you should be ok too. I wouldn't worry.

Yes, we don't have to wait for priority dates to become current. What that means is you can file I-485 now, but if the priority date retrogresses beyond your priority date, then your I-485 cannot be approved until that date moves past your priority date. You need to hope that the priority date they're processing is past your priority date at the time they're going to approve your I-485.

But it's still better than not being able to file I-485. At least you will go through the fingerprinting and you will get your EAD, which isn't affected by priority date retrogression.

Yes, my wife came to U.S. to work for employer A, but once she landed in U.S., she had employer B sponsor her H-1. She worked for employer B for 6 months, then moved back to working with employer A, because that H-1 was still valid. No problem.
