No, the US IO was flipping through the passport page by page...and somebody distracted him by asking him a question. He then forgot about it and never saw my Canadian PR visa. He is the one who asked the question: So, where you in Canada for vacation/visit? I answered yes, which is true, because I was on vacation and I did go to visit. ;-)

I entered through the Peace Arch Port of Entry.

Just create your own List of Goods in Excell or Word and also make sure you total the value of the goods.

Landing and return to US went without a hitch!!!!

==Canada Landing experience & questions:
There were 2 officers: one at a booth, doing a triage and one inside the immigration office:

First Immigration Officer questions:
1) Where is your home?
Originally from Mexico, leaving in the US now.
2) Do you have more than 10,000 with you?
No
3) Is this your car?
Yes.
4) Do you have any alcohol & tobacco with you?
No.
5) Do you have any arms or weapons with you?
No.
6) How long are you going to stay in Canada?
A couple of days.

Ok Sir, drive to the parking lot and go to Counter B in the Office.

Second Immigration Officer questions:
Waited about 5 minutes, stepped up to the counter and told him I am here to do my landing:
1) Where are your papers?
Gave him the papers... He started reviewing all the papers very carefully, checking every number.
then he said... I am going to ask you a few questions:
2) Have you been denied entry in any country?
No
3) Have you committed any crime in any country?
No
4) Have you been deported from any country?
No
5) Do you have any dependents that will come with you later on?
Yes, only my wife and son.
6) Do you have an address in Canada?
Yes, I gave him an address from a friend in Toronto. That's where the PR card will be mailed.

Then he asked me to initialize on the immigration paper the questions above..
He started doing stuff on the computer again and then
7) How much money are you bringing in Canada with you?
~ 17,000 $, gave printout of Bank of America statement. He just copied that number in the computer, didn't really look.
8) He asked me to sign on the green box, and had to be very careful not to touch the green margin, because
otherwise they have to redo the entire paper again...Asked me if I wanted to practice on a sticky note...I was like, I am fine , thank you ;-)
He went back to the computer, did a couple of things...took a stamp, stamped the papers and then
9) Do you have a list of goods?
I gave him 2 copies of the list of goods...He liked that because he said one is for him and one is for me.
He started to fill up the customs form.
10) Asked me if I have any cars to import?
I said no.

He signed & stamped the customs form; gave me a copy of the form and list of goods.
Stapled my landing papers to my passport, stamped my passport and said: "Congratulations! you are now a Permanent Resident of Canada!!!!"

==Return to US experience & questions:
Cross back to the US on Saturday; Waited about 2 hours and a half in the car; there were lots of people crossing.

Again, three officers asked questions, two were outside the booth, the other person inside the immigration office:
First Officer:
1) I just showed him my passport and my AP.. he said ok, you just need to have it stamped Sir. Just go to the first
booth.

Second Officer:
1) Ok, you have an AP, we need somebody to stamp it, please park in the front over there.
I parked the car and walked to the office.

Third Officer Inside:
Waited there for 10-15 minutes.
Waked to the counter and said I have an AP. He took a copy of the AP and the passport.
Then he starts looking through the passport, on every page...then suddenly, a new officer comes and asks
him a question on how are the AP "cases" done...she was relatively new.
So he starts expalining: "So he has an AP meaning he has a work authorization; he started saying to her that
I probably came into the US as an H1 sponsored by the employer and then he asked me
1) where is my Visa?
I am like, i don't have a visa (my H1-B is expired), but here is currently approved H1.
He was like ok. He was showing her that.
2) Oh, so you have AP because you want to be a citizen, right?
I said, Yes, I hope so.
3) He swiped my passport...entered some stuff in the computer.
4) Asked for my address in the US.
5) took my fingerprints and picture
6) He was explaining the other officer that the new requirement for Advanced Parole, is that they cannot stamp the AP unless I showed a valid visa (The H1-B approval letter)... WHICH IS ODD because I didn't know this was a reuquirement...
7) Gave me a new I94.. and explained the new officer that there is no fee in my case.
Continued to stamp my passport and AP..
8) Explained I can use the AP to travel outside of the US anytime before the date on the AP.
9) Said the I-94 is only valid for one year and that I can only stay in the US for 1 year (again, I don't understand why he said that).

THAT's it!!!

Hopefully this will be useful information for anybody else planning to do their landing too..

Topic: Landing in Canada by driving from Seattle -> Vancouver

Hi,

My husband will be driving from Seattle and do the landing in Canada in a couple of days. He
has a pending I-140 & I-485, with a PD since March 2005 on EB-3 Mexico. We did obtain the Canada
PPR in about 7 months and since we have no way of knowing IF and WHEN the US greencard will be approved,
we decided to take the "risk" and do the landing.

He plans to re-enter the US using the AP. His H1-B is expired and is about 3 years old so we don't think he can use
the AVR.

Does anybody have any recommendations or suggestions on the landing process and the return back to the US?

What should a best answer be to a US customs agent if asked why he has the Canadian PPR?
The reality is very simple and I think that may be a best answer: he went to satisfy canadian immigration status and
to visit BC. The reality is that we don't yet know where we want to be living permanently.

Any suggestions? Any recent landing experiences ?

Topic: 2 parallel EAD applications based on F1 and AOS

So I have put all the EADs I applied for before (EAD on undergrad F1 and EAD based on undergrad F1).
I didn't put at the time the EAD for the AOS, because the lawyer was just about to file it, and they didn't have it
sent at the time of my application for my EAD for F1.

So, in my case, I had no problem. I got the EAD based on F1 and the EAD based on AOS; and I did
provided them with my A#, which, in essence, should have told them all my immigration history and status (e.g.,
had pending AOS status).
Now, I don't know whether it made a difference, but my EAD-F1 was filed in TEXAS while my EAD-AOS was
filed in NEBRASKA.

I think it is very good for your wife to try to maintain independent status as long as possible...just in case
something happens with your AOS application, she can remain legally here on her on status, at least until
one figures out what to do. That was our way of thinking and I think that's ok.

Topic: I-140 Pending - can I move to a different city and State

Hello - I have a question if I can move from the city and state where my labor certification was filed and approved. Currently I am waiting for I-140 to be approved and I have submitted I-485 concurrently - I have EAD and AP approved.

I have been looking at AC-21 and the Yates memo but I do not see any references to changing city and state while waiting for I-140.

If anyone could shed some light, i would really appreciate it. Again, I am not changing employers, and not changing the
job description and position; only location.

Hi kaushikks,

Here's what I think. If your wife was previously on F1, then you guys did AOS, then you left the US to go to India,
and got back in the US using Advance Parole, then your wife is *NOT* in F1 status anymore.

My situation is different (I am still F1, without exiting the country or using EAD based on AOS, and all I wanted to
do was to prolong F1 status, even though I have this AOS status as well, since I've been told that one should
try to maintain independent status as long as possible).

If your wife was not F1 before you applied for AOS, and tried to apply for F1 after both of your were on AOS status, then
F1 was probably given mistakenly...because if you're on AOS status initially, you cannot have F1-status as well.

My advice would be for you to go to your immigration lawyer that can write a letter stating for the school officials
that you guys are in AOS status, which may be similar to Resident status for in-state tuition purposes.

Though, I don't know...maybe the school official is trying really hard to make sure you don't get the in-state tuition rate.
Check the school definition as to what qualifies as resident...do you actually have to have an approved GC or citizenship (?)
I personally don't think so, but then again...

You could also take copies of your AOS paperwork and show them to the ISO; though if the school's ISO doesn't know
that if one has AOS status that's considered resident...then maybe the ISO is not properly trained in immigration law.

Topic: Archived Visa Bulletins: What happened in January 2005?

Hi,

I have a silly question. I have looked at *every* single month since April 2002, and
for employment, every single category has been CURRENT. (Family is a different case).
Now, right in the January 05 visa bulletin, one notices retrogression for about 4 years (to 01)
on certain categories.

I find it hard to believe, that statistically speaking, they have been having such a surge
in Green card applications end of 2004 - until now. Does anybody have an explanation for this?

What's funny is that my OPT EAD is submited at Texas, while my AOS EAD was submitted
at Nebraska. Maybe their databases are not synchronized. ;)
