How will USCIS decide whether to issue an EAD valid for one or two years?

USCIS will decide whether to renew an EAD for either a one or two-year validity period based on the most recent Department of State Visa Bulletin available at http://travel.state.gov/visa/frvi/bulletin/bulletin_1360.html. If an applicant’s visa number has retrogressed and is unavailable, USCIS may issue a renewal EAD valid for two years. USCIS will continue to issue the EAD in one-year increments when the Department of State Visa Bulletin shows an employment-based preference category is current as a whole or the applicant’s priority date is current.

At the time of processing the EAD, you were not current as per the latest published VB....

Get your facts right.... Who told you all govt. agencies work 3 days? They work only on Wednesdays. They plan on Thursday and Friday for the weekend and brag about the same on following Monday and Tuesday.... :) :)

Mmmmmm..... I beg to differ with you, Sir. I am not applying through NIW, so I haven't educated myself on the finer points of the same. But, my common sense drives me to conclude that 'National Interest Waiver' would include everything under the sun that protects the 'National Interest' of USA. Wouldn't economy be among the first things that US would like to protect? Actually, in the current presidential race, the American people rate economy as even more important than the security. More patents means more protection from the increasingly globalizing economy. And the news has just come in that for the month of February, US had a net loss of 63000 jobs. This is the highest for any given month since March 2003. So, all we can do is sit tight and hope better sense prevails for the adjudicating officer to see through the benefits that an applicant brings on.

To add, I am not refuting the argument of 'Enduring'. I totally agree with him, while patent filing record or an ability to do so would compliment whatever 'Enduring' has said and just help further the case.

Correct me if I am wrong...

F1 is not a dual intent category. The time one files an immigration petition, the petitioner goes out of status of F1(the non immigrant intention is violated here), if he is already on one. So, will one be allowed to file new F1 when an immigration petition is pending? I don't know. But, if they do, then it would be very reflective of USCIS, which never makes sense to any logically thinking person.

While I am in the dark about filing patents for US companies from outside US(I thought the subsidiaries would take the credit, if done through a subsidiary, and in turn the credit would go to the country where the subsidiary is located), I do not agree with patents being of no use to US. The research is not done with the only motive of charity, humanity, compassion, etc., Money is the major driving force behind research. If there is no RoI on the money invested, the research itself will not be sustainable after a period of time. What better way of locking down the formula or process for 21 long years than filing a patent? If there is one, I would be glad to learn.

I think I am going off the topic of the original poster. I intended as a suggestion which could be pursued and not as THE way to go...

Topic: Lay Off < 180 Days, CHALLENGING SITUATION!!!

A possible solution.....

1. All the days you spent outside the country not working for the sponsoring employer does not count towards the six year period of your H1B. So, transfer your H1B and you should get an expiry date past 9/12, assuming you have spent more than 52 days outside the country during the entire period of you H1.

2. Apply for an extension on 13th September for a one year extension. (You can continue this until your GC is approved)

3. If you couldn't find a direct employer who is willing to transfer H1 (because of your short H1 period), you can always go to consulting (Body shopping) companies who are willing to take a cut out of your pay and sponsor H1 (Please, do not take this as an advocacy of anything illegal. I neither myself do nor advocate others to do anything illegal)

4. After you get the extension, you can go to an employer of your choice.

Topic: USCIS Issues Revised Instructions for Travel Document Application

I remember reading somewhere that there are efforts to combine the collection of biometrics for I-485 and I-765 to reduce cost, processing time and better customer service, if any. With in a week, here we are, requiring yet another biometrics and an additional fees to go with it. Though I have become immune to USCIS's stunts, I couldn't help but comment on this. Is it really that difficult not to be utterly stupid?

To add to it, I think its high time USCIS out source the GC processing. If they are skeptical of out sourcing to other countries, I feel at least they can do it to trackitt. I am sure most of the trackittians would be able to come up with a better process, better IT systems and better customer service in a fraction of a cost USCIS is spending on this.

Topic: Spouse burnt finger....FP coming up

My wife was sick on the day of fingerprinting and they refused to take sick people. So, they asked us to come on one of the two walk in days a week (Wednesdays and Saturdays between 1 PM and 3 PM). We went the very next day and got our fingerprinting done. So, there are walk in days (at least in some ASCs). Hope this helps.
