One of my friend had this experience. He took InfoPass and explaained that it's more than 90 since he applied for EAD. The IO took his details including his e-mail ID and mobile number. She told him that she will call back in four or five days. She did call him after four days and told him that his EAD has been approved. I think the general rule is that EAD needs to be approved within 90 days if not then it can be expedited through InfoPass. |

Your H1b status stays true as long as you have a valid H1b document with the company you are working for and have not used your EAC, even if its not stamped in your passport.
That's correct. That's what my lawyer told me. I went to India and came back on JAN 2008. I used AP and worked using H1B until I received my GC. |

As far as I know if you use EAD and if I-485 gets denied then you are out of status and mostly they will give 10 days to leave the country but one thing I know is if you use H1B then you will be on H1B status. May be you need to consult a lawyer on how to extend the H1B in case of I-485 denial. Onething is for sure there is very remote change these days for I-485 denial as long as I-140 has been approved. |

I currently have 2 yrs still left in 6 Yrs of H1. I have a pending 485 So i was planning to use EAD.
As per my understanding it is always safe to use H1B instead of using the EAD. If my 485 case has been denied i would still have valid status. So i was continuing on H1B But i got some different views regarding this.
One of friend adviced me to keep atleast 1 and half year on my H1. When i have one and half year left on my H1 he advised me to use EAD instead of H1.
If my 485 case gets denied during that time i would have to file for H1 immediately. Since i have one and half year left on my H1 i would still have time to apply for labor and get H1 extensions after 6 yrs.
Please provide further guidance on this issue... Has anyone been able to do this....

Please continue using your H1B. H1B becomes void or invalid once you start using EAD. You cannot go back and use your H1B if you started using EAD and I-485 gets denied. You can extend your H1B beyond six years based on pending labor or pending I-140 or approved I-140 until you get your GC if you continue maintaining H1B status. Two of my friends are still using H1B and they filed I-485 last year. One of them is staying for more than six years. They did not use EAD. You can still stay in US if you use H1B in case I-485 is denied. If you use EAD then you will be considered out of status once I-485 gets denied. |

Mickey, i believe she can go back to H1B as far as i know (need not go out of the country as long as I-94 not expired). Spefic details regarding this - i don't know. Talk to very good attroney ASAP. What is the reason for 140/485 denial? Best wishes.
H1B becomes invalid the moment somebody uses EAD. I think now she can go back to H4 status since primary is in H1B status. |

Hi Can some one please answer this qn. Pls.
I filed my I-485 (Emp based) in July-02-2007 and my wife (H4) later filed the I-485 applicaiton in July-24-2007 and we both have been assigned the same A#.
Is this something common or do I need to call the NSC to let them know about this.
What is the more efficient way to get this resolved?

Both must have different A#. It's not normal. It's better to talk with your lawyer about this so that they can sort this out with USCIS. |

Not anymore. A case can be assigned to officer if name check is pending for more than 180 days. |

Had an infopass appt this morning, where I was told that our namechecks are cleared finally. When I checked as of two weeks ago, they were still pending. I was told that our cases were assigned to an officer on July 31st. Any hope?
