Topic: Switching to Counsellor processing after filing 485

Hi bayareagc,
contact your local congman/woman immediately. Thats your best shot. Calling to uscis doesn't help most of the time. You are almost there, just need a kick from the congman to open the file.

Apnadude or others who are waiting since 2005-2006 with current visa no.
Get in touch with your congman, it does work, at least worked for me. Mine would have sit for another 6 months easily, concted congman and got approved in few weeks. Goodluck.

Any idea about the current status of your case ? my EB1-EA is pending with Texas since Nov 06, I called TSC early this year and learnt through SR that my case is stuck in ''additional review''. Waht a mess!

Hi there,
trying to figure out how many 1-2 years old EB1 cases are still pending with USCIS ? I am one of the unfortunate one whose case is pending with TSC since NOV 2006. Initially it was due to name check now god knows why ? Got a response from FBI againt a letter to F. Lady and learnt the name ck was settled and fwded to USCIS on NOV 2007. Six months over since then no response from USCIS yet. my useless Attny. is asking $5K for a law suit, don't know what to do ?
If any one with similar/earlier time range is still waiting please share your experience. Thanks

Topic: EB1 case overdue TSC Center

My case is pending in TSC (I-485, EB1-EA) since Nov 2006. I am stuck in name check. Just wondering how the name check for the folks who applied in June-July is getting cleared so soon, irrespective of country of birth ???????

When was your I-140 originally filed ? normally you get your decision soon after sending rfe response. If don't want to take chance then go for premium processing of I-140. Once your I-140 is approved you can get 3 years of H1b extension. Otherwise also you will be able to file I-485 once your I-140 is done and as soon as your visa number is available. Then you can stay with EAD and AP as long as your I-485 is pending.

Hi yanini,
You got to take the skin test unless your doctor think otherwise/find a very good reason to avoid it. Yeap, asian doctors might be a better choise. I got rfe for skipping the skin test, I am from asia and was so afraid to take the test thinking it will come +ve. Eventually it turned out to be negative and I heard from many friends from similar geography that they were also negative. So don't speculate too much and get the test done. Dr.s will help.

Yes, you will need to visit twice. After the shot Dr. will examine your hand after 48-72h.
