How can you convert EB3 into EB2? Please advise and let me know if I missed something.

beachstreet: If you happen to go back to India (hopefully on your own volition rather than being forced), people of many nationalities (including India) will get the social security after your retirement age if you have worked here for 10 years and accumulated 40 credits. Medicare you lose out completely.

Hey Torome: Sorry about your denial. Also, the AAO in your case answered fast. You filed in Feb 09. and got an answer in July 09.
Do you have H1B? Try to extend that. I think EAD becomes invalid while I 140 is denied. Good luck and let us know if you have any questions.

I filed in july 10th 09, nope don't have H1B and yeah they answered very fast, why? because they said didn't get the package yet my attorney send it back again with proofs that he send it not once but twice to nebraska & AAO in Washington DC.
ERROR ERROR ERROR from CIS.:( so I still have hope.

Are you saying that your case is still pending at the AAO after 2nd delivery?

And FYI, there are a number of ROWs who are stuck in EB3 for so many years. Not every ROW candiate is fortunate to file in EB2.

Adjudicator my friend, I totally agree with you. As you all can see my I 140 is denied, but even individuals whose I 140 was already approved for a long time were still waiting for 5-10 years. Check the dates and records on this forum and you will see it yourself. I do not see any difference between ROW-India-China and etc. . I think the Labor backlogs from 01-05 (before perm) harmed us all and many of us suffered.

I dont think H1B costs more than few hundreds, if it was filled for second and subsequent extentions for same employer. May be 3G is including attorney's fee. Before I left US, I obtained my 9th year extention for 3 years, based on approved 140 and pending 485, which was done from my friend's company. and it cost me about 1800 including attorney fees which is usually 500 approx. So, try to get H1 from some small consulting company, and keep working on EAD with your current employer, so if any worst thing happens than, you can still have H1 from different employer.

Guten Tag Adjudicator. I remember you very well. I did check your name since you have a high number of posts and I knew that it might be you with a different name. My case is still pending as MTR. I had 2 SLUD's in July and my PD for Appeal is Feb 09. I hope to receive some good news soon. There is no reason why I should not be approved. But you never know with these people. How about you? Are you going to extend your H1B?

Denial of I140 does not invalidate 7th, 8th .. year H1 extensions. EAD, 485, AP etc are immediately invalidated, not the H1. You can MTR, I290 etc the denial to your fill and till its *final*, and all thru this, you'll get one year H1B extensions.

Hey adjudicator: I would go ahead and just in case extend my H1B for 3K and even pay the prem. proc. fee. Do not save on immigration as I have been always saying to everyone on this forum. Believe it or not look at my details as a ROW applicant. It is worth it at the end. Good luck and keep us posted.

i do not know if this correct? In my case 140 has been denied and we filed MTR/APPEAL and they sent my case to AAO. A week ago i got letter from USCIS stating that my 485 has been transferred to NBC (National benefit center). If MY appeal has been sent to AAO why they didn't deny my 485 instead they sent it to NBC?

habsim672: They do not always deny I 485 along with the I 140. Some people get lucky and their I 485 stays active. There is no rule that if I 140 gets denied so will be the I 485. I hope this helps.

thanks ygvjs2000. This is something that I learned as well. But I heard once your file is in AAO your 485 is denied. Anyway I would consult a lawyer.

I filed I140 in June 07, I290B in Oct 08 and no filing for I 485 yet.
In addition to the questions abouve about LUD; one more question:
Should I file I 485 as well?

LUD on Wednesday is good. It seems like they are processing or they have opened your case. at least it is a movement, but of course you never know with them. Yes, you can certainly file I 485 as you are EB2. Your VB is always current b/c you are ROW. Oh, maybe not b/c your I 140 is denied. I do not know. Sorry. ask you attorney or call uscis customer service. But, I still think you can not file as I 290B is still pending. good luck.

Some more info;

I appealed to the denial of my original I140 application about 8 month ago by filing an I290. Initially, on USCIS website profile page, it stated that they received the appeal and will process in due time. Last several weeks, I used to see LUD on Sundays with the long statement "The I290B NOTICE OF APPEAL TO THE COMMISSIONER was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you etc...). And today I saw one posted with similar wording (July 29, 2009).
My specific question is;
Is it unusual to have LUD on wednesdays?

or are we going crazy to read too much into LUDs?

What is your PD? What EB category are you? When did you file I 140 or LC? Or even I 485?

Does anybody have new LUD today about I290?
What does an LUD on Wednesday mean? I thought it was regular to have LUDs on weekends, right?

One more thing. Can you put your case details if you want to get answers to your questions.

Guys: Let's wait patiently. With USCis you never know what it means. My attorney said not to draw any conclusions. I hope it will be good news for all of us.

Welcome on board SLUDs. I had some SLUD on 07/18/09 as well. It is either 100% good news or 100% bad news. Do the MTR/AAO guys ask for RFE?

kakurusr: I checked all the files on the link above as well. Also, now April 09 is added to the list. I think the files that are listed are all the rejected files. Approved cases might not be posted there. Just my thought I might be wrong though.
