Topic: L1 extension denied ,I 140 and 485 pending what will be the effect on my GC roadpath???

Hi,

i think denial of L1 extension will adversely affect your I140.
3 different attorneys ( Murthy, Rajiv Khanna, and another one in Detroit) whom i spoke with when i applied for my L1A extension told me that L1A extensions are difficult to get. i was also told that L1A's are getting lot of denials even for extensions recently. They also told me that if i get the approval for L1A extension, then getting I140 is easier.

Topic: RFE after 8 years waiting

if he has been on EAD for 2007, then he can show 1099 but what if they are asking for the W2 for previous years.

Topic: RFE after 8 years waiting

Guys

Is there any difference between W-2 and 1099 for USCIS purposes?

-------------------------------

Zma,

Proof that the employer has paid and paid on time is all that matters. it also matters that the employer is authorised to have this person as an employee. but from what Bestia says, i think non-availability of W2 will be a big issue.

it USCIS has asked for 10 different things, skipping one and making up on the other aspects of the RFE reply should be ok i think.

Topic: RFE after 8 years waiting

Today I got the first RFE, they ask for several docs on my petioner ability to pay, NEED YOUR ADVICE, they ask for "employer DE-6 quarterly wage report, including front and back copies of canceled checks " , and my petitioner ownes a small business and just work with individual contractor, means no W2 , what should I do?

----------

the number of employees does not matter. make sure you submit all the papers to prove that your employer is a profit making business doing payrol regularly. you should have been filing a quaterly payrol report to the IRS. you will need that. Also, you will usually get a quaterly report from your payrol service like ADP and/or will also receive a quaterly report from the state for state Unemployment insurance etc. If your employer does not use a payrol service, then get the company accountant to prepare quately reports (check with him, he would have filed quaterly and yearly reports).

you have mentioned that they have ASKED for W2's. have they?
