I used cross-chargibility when I applied for I485. My PD is October 2006. I don't think NIW cases have any advantages especially in NSC. My I140 was approved after 14 months. |

I also did not have a birth certificate. So my lawyer suggested to get a non-availability certificate from Indian Embassy in Iraq or from Iraq embassy in India or US. I tried the Iraq embassy in US but they were not helpful instead suggested me to go to Iraq to get it. However, I was able to get a non-availability certificate from Iraq Embassy in India stating that at the time of my birth they had a policy of not issuing birth certificates to kidss born to foreign nationals. I also provided three affidavits along with the certificate (my parents and one of family friends who was in Iraq at the time of my birth). I also provided copies of the visas for my parents and family friend and proof of them working in Iraq at that time (like experience letter or appointment letter). Ask your friend to get the non-availability certificate from Iraq embassy in his/her country. I hope this helps. |

Finally got the Card Production ordered emails on 2/12/08 and Notice Welcoming New Permanent Resident email today.
My case had been stuck in name check since November 2006 and this was confirmed over fone couple of times. hoever after the new ruling regarding namecheck I called on 8th February and the IO said that my case is waiting to be given to an officer but he could not tell me how long it will take. Looks like all the old cases will be approved pretty soon. Good Luck everyone. |
