This threatening gives you leaverage to get the AC21 job offer from your future employer. I would get that letter in hand so that when I decide to send it in I have it.
Also, its random when it gets to your case (if it does) if you send it in without RFE. The RFE will get right back to your case so you can put the A21 docs in with any RFE. It has a barcode on it to make sure it gets associated back to your case. |

Topic: Biometrics for EAD
Whenever you do EAD online ...you usually get biometrics.. My family did about 10 times.. then on the 11 th time.. I did EAD online but then sent in 2 passport pictures just like they do with the paper filing with EAD...and this time they just gave us the Card Production Ordered email without the Biometric. Not sure if that is normal but that's what happen to us. If you do EAD online...right away send all the followup info to them for your case so it can be quickly adjudicated for you. Times seem very good compared to before.
No biometrics associated with paper EAD filing so many people go that route to avoid the Bio.

I think what alot of people are saying in here is total bull. A top super lawyer told me that it just has to be similar, it such as if IT still in the IT field. That might be pushing it but he does thousands of these similar ac21. Also told me if company won't produce an acceptable work employment proof that he would sue them. He was not kidding. Try to get the best letter you can.. also just give a brief summary of the work details not a long laundry list and your chances should be good. |

Its a great sound bite that will stick. It would give them a picture of what we are facing without trying to just slander.
It would have to be the right time and the write way... a letter program might have some bite or some congress person

Do you have to do that? The company lawyer told me that he will just send a copy of the old I-140 approval with the new filing.
May be he is not telling me those details.. or is missing it.

Get a lawyer experience in this type of proceedings. I only use a super lawyer who knows his stuff.
You seem perfectly fine...but the immigration system is seriously wacked. Don't go down in flames with a so-so lawyer..he has nothing to lose.
If you have a good job now and want to wait for the GC, I would get a kick aZZ lawyer and make sure you navigate this legal landmine.

5. Fraud of multiple kind - denied
6. You dont answer RFE - denied ( or fail to get the documents in-time and no money to file MTR - screwed)

8. Underlying I-140 is revoked by company 180 days - denied no money to open MTR

I don't think so.
If his h4 is based on your h1B..then he may need to re-enter at board to re-establish h4 if you h1b was still valid.
If he has 1485... in process then he ok in that state until adjudicated...but if not on ead.. then you could get back on h4 for safety.
I am on h1b, have 485 file for all ..and they let all their h4 expire..and started using ead.
Why a h4 would be denied? weird. What was the reason?
I dont think it will affect AOS... make him get an ead and get to work... the lazy bum.. :D just kidding. |
