This is what happened to my pending AP yesterday

Application Type: I131, APPLICATION FOR USCIS TRAVEL DOCUMENT

Current Status: Document mailed to applicant.

On September 5, 2008 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.

no worries get a stiff drink and enjoy...i140 after 180 days becomes portable even if employer withraws it.

I would say go with your gut feeling. If you have confidence and ready to fight go for it.

Hi,

My I-140 got denied on July 28th, and my future employer does not want to continue further on this green card processing.

He does not want to file a MTR or a new I-140.My H1 is expiring in may 2009.

I have not been able to my current employer regarding filing a new green card for me yet, since my manager is on leave.I talked to my current employer attorney, he said even if the Current Employer agrees to file a new green card, the labor should be approved and I-140 should be filed for me to renew the current H1.

I have been trying to convince my future employer for filing a MTR/new I-140, he says due to company financials, he does want to sponsor me any more. What are my options at this time? Please advise.

Topic: Submitting Experience Letter before RFE

No you dont need to and also you cannot until and unless there is an RFE.

I was in similar situation as yours, I had MS +1 yr exp with my gc sponsoring employer and job requirement was MS + 1 yr exp and I could not submit experience letter for my past employment. However I did not get any RFE and got my I140 approved. So you you can obtain the necessary letters and keep it with you to respond to RFE in timely manner if there is any. Hope this help to both of you.
