Topic: Appeal on Denied Perm Case

My case was filed in July begining 2007.I was audited and denied.Attorney sent an appeal in NOV 2007.Still there is no update.
Anyone knows the denial dates processing time?Are there chances of approval?as the reason was minor and was fully justified by attorney.

I appealed my 2003 labor which was in RIR EB3, denied. This was in march 2007 and still pending. My company filed another labor during march 2007 in perm EB2 and now it is going smooth. Not even worried about the Priority dates, as I feel more comfort on clearing the labor and 140 and comfortable with 3yr extension in hand, than waiting on appealed labor.
I would suggest, go with appeal, but not to count the time on it to be ready. Inspite, go ahead and figure out the options for filing another labor which can be faster than the appeal result.

Any suggestions? I am not sure in which category I need to ask, but found this relatively better slot, as many of 485 guys on PD are oldies and they should be having the better idea.

I am trying to enter my damn old labor details in the tracker. The labor was applied in March 2004, and subsequently transfered to back log reduction center at texas, and then got denied. That was my 5th year in USA though, and applied for AAO, still sleeping over there. No result yet.
I am not able to find the tracker for dallas backlog reduction center to enter those details for followup, as I don't want to loose touch with that sleeping case, who knows with USCIS, how we be benefitted at what time. This can be best bet to port my PD if things work out...:(

Thank you for your suggestion.
She never used her EAD until now, and we got our 3 yr extension recently. i am planning to get her visa stamped. We have the AP as back up, in case if she fails to get her visa stamped.
My question was about next run , if once she jumps onto EAD and he scenario if she looses her job some time down the line, for down market or what ever reasons, can she use her H4 stamping for travelling. I want to rely on visa stamping than waiting for ever on AP approvals, down the line, as the H4 is valid for next 3 yrs until 2011.
anyways, I am gonna figure out with attorney too, only concern is he might be expecting us to file EAD extensions through him.

once she used EAD for work, she can stay on EAD untill and after expiries...(even she quit the job ..what is the problem), if u r 485 is pending she can stay legaly in USA...no need to work. for traveling need AP.as for my knoweledge once she used EAD she is on EAD status.not sure why u need H4 status back...any reason.

1. Yeah, the reason being I wanted her H4 to be stamped which is valid for 3 years before our AP expires in Feb 2009.
2. After that, working on EAD, and for some reason if she needs to get back from EAD, yes, she can be pretty well on status, but can she use the same H4 stamping for travel she have in hand, after quitting the job on EAD?
This would save me time and tension in waiting for AP approval as well as cost effective.
Any inputs ?

why, the point b. contradicts?
My understanding is if you have applied for I-140 with company A and did not apply the 485, then you are not eligible for AC21 rule where you can carry your labor and I-140 to the new company B.
If you have applied for 485 from Company A and have already crossed 180 days, and join company B, then you fall under the AC21 category and you can continue your labor from where you are.
I don't see any contradiction there. Correct me if I am wrong.

Sorry to hear your case.
I would suggest to go with a good attorney on this. Anyway, my inputs,
a. Is there any validation period for the transfer/extension receipt?
I don't think there is any validity, but the approved/denied document goes to attorney or to the employer who filed for you. Follow up with them. Also, try to check the online status and see how you can follow up the case. Discuss with good attorney.

b. Can I re apply to another center for H1b extension even after my previous visa has expired (another problem is the most current pay stub I have is for month of May, ‘coz my previous employer used to direct deposit my salary and never use to give pay slip unless asked)?
This needs to be discussed with a good attorney, and worth it even it costs. As far as I know, no employer can hold the pay stubs, so demand for them and get them. Tell them politely you need the paystubs and hint, it is his responsibility to give you the paystub.

c. Am I legally allowed to stay/work in US and for how long?
I would say Yes, but again discuss with attorney. As long as the H1 petition is on process, you are good to work.

d. Can my husband apply for my dependent visa, when he is on OPT? for this change of status do I have to leave the country?
Not sure.
