My spouse's EAD got approved yesterday(Friday). I got email on card production ordered from CRIS yesterday evening. I did update status on another thread and also i updated status on I-765 tracker as well. Mine is still pending. btw for this approval RD 08/01/08. CPO 08/29/08. |

Thanks greenglobin. The H1B sponsoring employer is a non profit organization. As far as I know they are not subject to cap. However i will confirm. |

Hello Gurus, I am currently on H1B valid until 2011 (Beyond 6th yr) and my AOS is pending with an EB3 approved I-140. My spouse was on valid F1 until May 2008 until she graduated. Now she is on pending AOS since then. We both applied I-485 last july 2007 and have valid AP and EAD. We are planning to travel to India and reenter on AP next month. My spouse has a job offer and the employer is ready to sponsor an H1B visa after coming back. My question is
1) As we will be on parolee status upon reentering, Can my wife apply for new H1B ? ( H1B will be under non profit)
2) Will applying and getting approved for H1B lead to denial of I-485 or make I-485 invalid in any way?
3) Can she go back to home country and stamp her H1?

Update!!! The check for my spouse also cleared from the bank today. It took almost a month now. I have to check what receipt date will come up on the notice. As of online it shows August 1st which I believe is the date the notice was generated. My patience paid off!!!!!!!!!!!! I think the check cleared within the USCIS 4 week window period!!!!!!!!!!! |

Did your checks get cashed? If yes you can find receipt numbers from the back of the cleared checks. My check got cashed about 2 weeks after my application was sent by my lawyer. Myspouse's check is still not cashed. I will call USCIS by end of this wek or begining next week. The receipt date is July 18th online and the check was cashed on 22nd July. |

Update!!! My check has got cashed today. I entered the receipt number on the back of the check and it shows receipt date as July 18th.I am not able to figure out why the application received is showing July 18 when my lawyer is saying they sent the application in first week of July. I will have to wait for receipt notice to see what date is actually on the receipt. My spouse's check is still not cashed. May be by tomorrow!!!! |
