Its true that NEVER file unemployment benefits with pending I-485. One thing which I think every one is missing (I may be wrong on this) is that his is EB2 employment based and not self petition. Although his I-140 is approved and I-485 pending but his I-140 is based on employment and since he is laid off now there are 2 things : his employer can get in trouble as they would have to inform USCIS that he is no more with them which could mean revoking his I-140 and second he is resigned and was not laid off. Also he did not use AC21 before joining the new job. Things are too complicated dude I think hire a attorney ASAP as every one said.

well not sure why do you want to take a Infopass now as your RD is 04/2008 and they are processing applications with RD 06/07. You have to wait till they have passed processing date of 04/2008. |

I feel that the IO would have called you to get some clarification over the phone so that he/she could make a decision on your case. There are few IO's who would call if the RFE is very small and the information can be got over the phone. So don't worry the RFE may be minimal. |

I think your application has being picked up by the IO. Also I have strong feeling that EB2 would move to 2005 in Nov 2008 as our applications were pre-adjudicated in July 07 itself but most of us got stuck due to NC. Also I feel there are few people with prior to 2005 and looks like many of them are sent to NBC for interview which may delay their applications a bit. This is just my thinking and I know things work differently :). But hey why not have some positive outlook and wait :). I have stopped checking LUDs 10 times a day but just check before sleep and after sleep :). |

Same here nice 2 see you here, same habit here too but I decided to be here more :).....well I think we both are on the same boat. Some times I feel I should have applied for NIW in 2002 or 2003 and not have waited till 2005 end. Infact my 140 got approved within 40 days with no questions asked as I am working in a field that's most required in the biological research and there are limited people in the world. I agree 485 has being a waste of time.....but I think we need to control our lives :) and not it be dependent on GC :). Lets keep in touch :)...I think you should contact your congressman, senator and FL also. Best of Luck!! |

Well I think the IO is right as many of us with PD or RD of 2005 EB2 had luds in the last week of Sept. Also I spoke to a nice IO today and it was confirmed that my application is still with IO and they are working on it. |
Topic: Additional Review - What does this mean?
Well I just got another SR reply stating that my application was pre-adjudicated july last year and they say that they don't have enough time to process in sep 08 and oct 08 dates have retrogressed. This is strange I think we need to have some action as to who can USCIS can approve applications of 2006 when they had so many applications waiting to be approved for older dates. I have 5 SR replies within last 2 months which have different replies. |
