Could someone please provide inputs on Future Employee Based GC Process?
How long do you have to work with a sponsoring company to be qualified as a future employee based GC?
Is it have to be before the GC approval or it can be after the GC Approval?

I still have 1.5 - 2 yrs of H1 left in my 6 Yr H1 Period. I would like to use this yrs in case if there is any problem with my GC application.
Will there be any RFE on my 485 application? (Like Employment verification Letter)? When would be a good time to join the GC Sponsoring company? |

I'm working with Company A for 3 yrs. I have filed GC (I140, I485) from Company B using Sub Labor. My I140 is approved through company B. I have an approved EAD based on pending 485.
My H1 with company A expires in Mar 2008 and i have used up to 4 yrs of my H1. I would like to keep my H1 yrs intact so if there is any problem with GC so that i can go back to my H1.
I would like to work with Company A using EAD from Mar 2008. Is it a good decision?
When do i have to work with Company B if my GC is filed as a future employee? I would like to work for some time to satisfy the legal requirement. Is it good join before GC or do i have to wait until i get my GC..

Sorry to post this question here.. But i have noticed a change in the job codes
I was looking at the for job codes here at this website. I was told we need SVP Range > 8.0 to qualify as EB2 Professional.
I have looked at this website before and managers were qualified as EB2. But i notice a change now which shows managers as EB3.
If i'm planning to apply for a new labor? What job title qualifies as an EB2 Professional?
Can anyone please provide more clarification on this issue?

Can you please give me a reason on Why you applied for your wife's H1? Why didnt you apply for your wifes EAD based on your pending 485?
Is it better to apply for H1B for your spouse. Even though she would be eligible to work based on EAD?
I know H1 option is safe... But the primary applicant can stay on H1 and the dependent can work on EAD |

Based on the current predictions i wouldnt be able to get my GC in next 6 months. it would be only after October 2009 i would have any chance of getting GC. This is a rough estimate i have seen people who have been waiting more than that.
So by that time i would be in the 6th year of my H1... So if my i485 gets rejected during that time.. I wont be able to apply for a new GC and get a 7th yr extension because i'm already in my 6th yr of H1. So i was thinking of using EAD Incase if there is any problem with my 485 i would still have some time left on my H1 to apply for a new GC and get an 7th yr extension. |

The reason why i'm asking is if my I485 gets denied in the 6 year of my H1. Then i wouldnt have any chance to extend my H1 after 6 years.
If i use EAD now i will still have like 2 yrs of H1 (Within 6 year H1 limit). In case my I485 gets denied. I will still have time to apply for new labor and then extend my H1 based on pending GC.
My Question is : If i start working on EAD My H1 gets invalid. If my I485 gets denied (Currently my 140 is approved) . Do i still have time left to do H1 Premium processing and get an approval before i go Out of Status.
