Topic: RFE answered one month back still no response

I am not sure. Thats sort of to the lawyer. I tried writing them a letter and got frowned as they supposedly sent a letter to my lawyer saying that I am not entitled. So, my lawyer was pissed. Now, I doubt he will do anything.

If they are so prompt in identifying and sending a damn letter, I hope they can take the time to decide to the case. Sadist SOBs.

same here. I have been waiting since October 9th. We sent on Oct 2nd and then LUD on 9th stating that they resumed. So, its been a good 45 days, no updates. Don't know if something may show up before Dec 9th or not.

I asked my lawyer the same question, and here is the response I got from her:

How INS determines the processing date is as long as they touch your case it is considered processed. Therefore, they did process your case on a timely manner and they requested for more doc's so the time frame on looking at those newly requested doc's doesn't count into the normal processing time frame.



That's just brilliant. I suppose there is no innate need to respect the 60 day window either. As they would say, it is just a guideline and in some cases, the guide says it could be forever.

You absolutely can. Loss of pay for an agreed upon time is an agreement between you and the employer.

What is outside of the processing dates for a RFE case? Is '60 days' the parameter or do you have to still go by the processing times?
