It is almost that time when USCIS start thinking about allocating unused visa # to other categories. Does it make sense to write a letter to USCIS director explaining situation with EB3 and request to evenly allocate the unused visa # (from Eb1 and Eb2) between Eb2 and Eb3. This way EB3 will also move forward little. Last year (2008) they allocated all the unused # to EB2. I do not think there is any law about this. There may a rule with in USCIS but they can always make adjustments. I think they have allocated unused # to EB3 in past, in 2007 or earlier. Your thoughts?

My Lawyer works for big firm.

Accoring to the Firm, The recapturing visa bill will be cleared and within 2 months time, both EB2 and EB3 will become current. USCIS has already started preparing for processing cases quicker based on the approval of the bill. This came from a reliable source.
The predictiion is $480,000 visa will be available and they must be processed within next few years.
according to one reliable source from my lawyer, these visas will be given to all the priority dates from 2001-2007.
anyone who has priority date after April 2007 will be processed in next year's quota.

Topic: What are EB3 India guys up to ?


I think the new policy of moving visa numbers sideways within the same preference category (EB1 and EB2 ROW -> EB1 EB2 India) has adversley affected EB3 ROW and India. I would have been more optimistic if number moved from EB2 to EB3 like in past.



I don't think it was changed. it is:

a. Unused from Family goes to EB for next year
b. EB1 ROW to EB1 retro countries (if any) then
c. EB1 to EB2 ROW
d. EB2 ROW to EB2 Retro
e. EB2 to EB3 ROW
f. EB3 ROW to EB3 retro countries

Am I missing something?

Count me in - Sep 2002, EB3-I

Hang in there guys. I think EB3-I/C will speed up when either EB3-ROW or EB2 is current. That's when spilled over (unused) visa #s will be allocated to EB3-I/C. There will be 120k visa numbers allocated to these 3 categories (EB1,2,3) in 2009. I don't think EB3 ROW can eat up 40k in 2009 or EB1,2 can eat up 80k. My guess is that EB3 will speed up starting April 2009.

Does it make any sense to you?

Gladiator,

It would take atleast couple of years to clear the EB2 India/China applications backlog, unless the senate approves the bill to recapture the unused visas from the yesteryears. Moreover, EB1 queue has very low volume compare to EB2 queue so there will be less chance for the spill over from EB2 category to EB3 category. Moreover, as per USCIS defined procedure EB1 unused visas should goto EB2.

Having said that, EB3 still has a chance. This time, USCIS have chosen the EB2 category to use all the spill over visas. Like that, in coming years, they might put EB2 on the back burner and give EB3 a chance to receive the spill over visas. In that year, EB3 cut off date might come close to the EB2 cut off date.

I think the spillover rule is predefind EB1 > EB2 > EB3, so they (CIS) cannot change it next year. My prediction is based on total EB1 and EB2 getting 80k numbers next year (2009) and I don't think there will be that many application pending in both categories.

Example: the current processing dates are no later than August 2007, if you look at the approved cases on this website and sort them by RD or ND, you will see cases approved that have ND or RD later than August 2007, like Dec 2007 or even in 2008.

I think all that matters is your PD.



are you serious galdiator, i have to force uscis to get my fp done, now i have to call them again to get my 485 as my pd is current.




Look at the data yourself buddy. I was surprised too.

Another possibility is if EB2-I/china becomes current and I think it will, that may happen later in 2009 when EB2 India and China get unused numbers. If they (India and China) cannot use up all the numbers then they will fall down to EB3. Remember EB2 get a lot of numbers from EB1, all together both categories get around 80k out the pool.

Ok, if you look at the pending EB3 ROW cases, there are not that many left. Every year EB3 gets 40k numbers. Ii seems like ROW and other cannot eat up all 40k in 2009 taking country limit into account. That means ROW will become current and my guess is around Feb 2009. Later in the year the unused numbers will be allocated to retro countries like India. So, I think it (EB3-I) could go up to mid 2003 by the end of 2009 (sep).
