Thanks for the response. My wages are exactly same. Job duties will be somewhat diffrent (from Sr sw engineer to sw engineer). But 140 is approved with sr sw Eng under EB2.
at the time of filing 485, employer needs to submit a letter saying that they intend to offer me a job of _____ after a get GC. I am not sure if they will say Sr sw Engineer !!!. That's Y i am worried. It is extremly big IT company and i will have little or no impact on there policy for filing. That's Y i am worried. |

My PERM labor was approved under EB2 Aug 2008 and I 140 (under EB2) in october 2008. After My 140 was approved my company was bought by annother big company. My company is now a Business unit of that big company.
Now i am being offered a position in the new company. I am not sure if the new position will qualify for EB2 any more. In fact i suspect that new position is one level below my previous position for which my labor and 140 were filed and approved. I am waiting for 485 as the dates are not current yet. Will i face some issue when my dates become current? |

we can probabaly also say that the legal indian immigrant have done extremly well financially and otherwise some pointers could be
1) Low criminal rate (Not many Indians are criminals in the country) some stats would be nice.
2) Are gainfully employed in high tech and scintific jobs.
3) run successful business e.g. subway, 711 etc.
4) Have demonstrated virtue of being immense patient.
5) Own houses. |

that's exactly my point, express your frust. in a new thread not when someone is telling you he is happy. if you question his approval you are implying that his approval is not justified and therefore it's not a direct curse but indirect one. Be careful to what you say in which context and i totally understand your point is valid but choise of forum (thread) to express it is not appropriate. |

wow man dont curse him if he got lucky, i guess all the july 07 filers were lucky too when he missed the boat. You all probabaly have EAD and AP where as this guy is still on H1.
So dont express your frust. over someone who is trying to share his joy

can any one enlighten me in regard to what bemefit i might get as a result of 140 approval. i know 3 year H1B is one of them but if my 485 is not filed, and i if i need to change my H1 to new employer in 6th year, will i still get 3 year extension based on 140 approval?
i will be more than willing to answer any question you might have regarding my case, first of all i had 3+2 year degree, i sent education evaluation that was done in 2004 at the time of H1 filing. My labor said foreign degree acceptable. my 3 year bachelor was in electronics and that's what they asked in labor so all 3 year degree holders all is not bleak and there is hope at the end of tunnel. |
Topic: H1B extension beyond 6 yrs based on pending 140
I just received 3 year extension based on labor approved (i know it is pleasent surprise when i was expecting 1 year extension and not 3 b'z my 140 is pending too. My 140 was not even filed when i applied for H1b extension.
can i transfer those 3 years to any other employer beyond my 6 years or that applies only employer who has filed my gc? |

100% true cpnf, we all are here because we wanted to be here. Let's grow up and not be a 10 year old whiny kid. America is a great place because people here are honest ,hard working and follow the system. I know many of us find it difficult to imagine that GC is not there right but privilage. Nobody promised you a GC and you were not born here is nobody's fault. You are playing a lottry and odds of winning it is better than winning a real one. |
