I know you can not control when someone trying to play a hardball, but you can certainly stop nonsense from your side.... You can simply ignore ...as matter of fact, you are the one who started the nonsense in the tread by talking abt BK and MCD.
If you are really intrested in answers, concentrate on the question.....
Anyway, I dont want to continue this thread in the same way....Here is what I know reg your question...
1. you should get your EAD and AP with in 90 days.
2. no one knows for sure when your 485 gets approved. In order for you to get 485 approved, your priority date should be current in the visa bulletin (Dec 2004-EB2I is current now) AND your application receipt date should be with in the current processing times of servic ecenter.
3. Also USCIS should have all clearences like name check, background check completed before approving your 485.
4. Above all, you need to have luck also ....bcos no one know how USCIS adjudicates their applications....

Unfortunately I dont have complete information of people and their location....Yes my employer is IT Consulting Shop.....
Coming to my application, nothing is falsified in any stage of the GC process and everything correct to best of my knowledge....
During my stay with this employer, I observed he is honest, pays on time and personally never has any issues..........Last year lot of H1B's approved and got visa stampes without a single query...I think all the queries and raids are part of current economic and employment situation | | | |

Hi,
I got my GC approved on 09/01 and received cards on 09/08. Received no RFE's from USCIS during my entire GC process and everything went fine.
I have updated my employer about my GC approval and he was happy to see getting approval. Because, recently my employer got lot of queries from DOL and USCIS when they applied for H1B, I-140. Some of the H1B applications also got rejected. USICE raided couple of I-140 beneficiaries residence to get more information on their employement stattus and type of job they are doing, basically to confirm they are doing the same job that was claimed in their LCA and their qualifications claimed in I-140. Fortunately for those people they were genuine. None of them got approvals yet, awaiting I140 approvals.....I9 inspections, H1B rejections and I140 queries and raids happened before and after my GC approval....
So here is my question.....
If USCIS finds some kind of fraud in the company fraud, will there be any impact on my GC, like revoking my GC????

Topic: PD vs RD & Sub Labor vs Reg Labor nightmare
As far as USCIS is concerned Application A and C are similar. As per Law there is no difference between Regular Labor and Substitute Labor. USCIS actually lsitened to concerns of people of like you and lot of others and removed Substituon labor process. While the Substitution process was in place USCIS considered both scenarios as same.
I know its not fair if some one who comes here later than you and gets AOS approved ahead of you just because of he/she took advantage of substitute labor. Everyone should be happy that this process is no longer there....
I hope USCIS has some rules while using RD, ND, PD etc... I personally feel USCIS should take PD ahead of RD and ND for the purpose of adjudication. Instead they consider RD and ND then PD...this is not fair too....Lot of people with later PD's applied on July 2nd 2007 got approved ahead of people with ealrier PDs, just because these guys applied in Aug 07. Its easy to sort applications based on PD and they can work on them first so that whoever is the AOS process first gets approved. Not based on RD......Its strange again its USCIS....so we have to live with that...

Topic: AOS Pending and I94 Expiring
Thank you very much for all your responses.
My H1 and Family members H4 was extended until Oct 2010 when I changed employer and filed my 485 through this employer. (Took labor substitution with this current employer).
My wife and Daughter had Visa stamp until Aug 09 from previous visa. When they went to India, they did not go for stamping again, but travelled with Old visa stamp in passport (valid until Aug 09) an dnew H4 extension papers (Valid until Oct 2010). At Airport the office gave I94 until the validity of Visa stamp, even after showing H4 extension papers.
Thats why they have I 94 until Aug 09. I did not travel so, my H1B extension is still valid and I 94 valid until Oct 2010.
I am currently working with same employer who filed my 485, and working on H1B. I have my EAD current and valid until Mar 2010. My wife also EAD valis until Mar 2010. But I do think EAD actually helps maintain status, its only for Authorization for Work. My daughetr does not have any EAD. All 3 of us have Valid AP until Apr 2010.
My assumption is since my wife and daughters AOS is pending they can stay legally in this country until decision is made of AOS. They do not need EAD, but AP if we want to travel abraod. Is this correct assumption or Should I look for an option to exntend their I 94's either by going out of the country an dgetting vis astamped and returning. In this market condition, I am reluctant to do that.....

We (Myself, my wife and Daighter) filed I 485 during July 07.
They went to India and came back in Apr 08 on H4 Visa. They got I94 until First Week of Aug 09.
I 94 is getting expired in few days.
Question is .....
1. DO we need to get I94 extended or Not Required since 485 is pending
2. If we have to get I94 extended, what is the procedure....

My wife filed her 485 back in Aug 2007 and its pending with TSC.
In Jan 2008, she went to India and came back in Apr 2008. She used H4 to enter USA and at POE immigration officer gave I94 upto Jun 2009 and its getting expired at the end of this month. (She had valid Advance Parole, but did not use show it at POE)
My question is....
1. Is it legal to stay beyond I94 date as her 485 is still pending.
2. Should we go and get her I94 extended?? Is it an option, if yes how should we approach??? Means, go to airport and request for extension or apply to USCIS service centers???
3. She is not (never) working. Should we get EAD and AP available always to maitain the status???

I had similar problem...entered JFK airport on July 30th 2006 and on the I94 POE Officer has written 30 Sep 2008. 2008 was not clear and it was interpreted as 2006 by DHS and entered the same in their systems. I looked at this on the POE, but the officer said it is 2008. When I went for DL, they declined to issue license because my I94 is going to expire very soon and I tried to explain the whole issue...But the guy in DMV clearly said, we cant help you and if you think you are going to stay beyong 30 Sep 2006, you better contact DHS for I94 correction.
I contacted DHS field office in Newyork and explained my situation and they accepted my explanation and issued corrected I94 with 30 Sep 2008 and updated their systems immediately.
So you can try at Chicago airport as previous poster mentioned, try to contact someone in DHS field office. The main difference between us is I have contacted DHS before the I94 date expired and in your case its is already expired. So you need to be careful while talking to them....may be its better you go with a attorney...If something goes wrong they might consider your spouse staying illegally...
YOu should be fine, because you already applied for AOS and you can stay irrespective of I94 as AOS Pending. I hope you had EAD from the date your I94 expired. Otherwise you may be in trouble as you worked illegally.... | | | |

JP is better educated than you and most of the guys in this forum. He left his well paid and well respected job and started campaining for better governance, electoral reforms and lot of good things. Myself personally attened some of his speaches and he has lot of ambition to improve the living standards of people in rural places. We need more politicians like JP in india.
I do not think driving BMW is great achivement. In one of the posts you said your mother land did not give you anything. You should be thinking otherwise....what is my contribution to my mother land. You got lot of things from your country...You are in this so called great country because your mother land provided you better education than lot of people get in this so called great country. After taking your degree certificate, you ran away from the country to drive BMW in so called great country.
It has become fashion to most of the people to talk rubbish about India. When you are not contributing to improve the conditions, you do not have any right to talk.
Let me ask you 2 simple questions...
1. When you enter to USA, you declare all the things in as per required by law. Please tell me honestly, whether you declared all the things correctly as per required by law when you go to India. If the airport authorities find out something which not declared, you try to bribe the officers. After that you come out and say airport officials are corrupt. Instead of paying bribe, why dont you declare and pay fine if you have to.
2. I am not sure if you had driving license in India. If you had, Please tell me honestly if you have got DL without paying any bribe or influence.
Lot of Indians are law abiding citizens when they go to foriegn country. But most of us try to bypass laws as soon as we land in India.....and we come up with convenient answer saying corruption. Stop encouraging corrupt officers and behave like a law abiding citizen in your mother land also....If every citizen abides by law, India also will become Great Country. Its people who are responsible for growth of the country.
If you do not like something, First please think of an opportunity where you can contribute to improve it rather than criticizing. Please be part of solution rather than part of problem. | | | |
