Topic: Spouse lost job - applying for unemployment benefits and impact on Citizenship application

The painful effects of the economy has a impact us. My spouse got laid off from the job. I am thinking of applying of unemployment benefits for her. I am the primary applicant and our GC was approved last month (phew...)

Any downside to applying for unemployment benefits when we apply for Citizenship later?

Can you please throw some light on your two 140s? like when did you file them and when they got approved etc?

My first I 140 was filed in 2005 and approved in Aug 2006. second one (EB2 was applied in May 2007) PP and was approved in sept 2007.

When you requested to link second EB2 140, did you receive any LUD on your 485?

How long it took for you to get approval after that?

FYI: I just saw soft LUD on my 485. as IO told me that she will link my second 140 to the file.

I am not sure what should i do next?

i already applied EAD renewal on 04/2/2008 and it is with NSC. My 485 is with TSC.

Can you please share your thoughts on my situation?





I did not formally request them to link my 2 nd I140 to my case. When my 485 was filed, it was filed with a copy of the receipt notice of my second I140. When the IO checked on my I 140 case on his computer, he was able to see both I140s attached to my case. I was just guessing that the EAD renewal triggered the IO to look at my case... I hope an IO would look at your case soon enough so that you get approved before they run out of visa numbers. Good luck....

Just wait... :-) you cant do much can you?? If you applied for EAD try applying for renewal to get their attention to your case....

Honestly I think nothing else worked for me including Speaking to an IO or even INFOPASS...




You are right. My EAD renewal may trigger their attention but since I'm working on EAD now, I had no other option.

You know very well that this entire Immigration Process is such a mess and needs luck at every step. There are people who get approved without a single RFE quickly and the unlucky ones get stuck for no good reason for years.

If and when I get my GC, I'm going to get on my knees and thank God. Even if I am in OFFICE !!

By the way, I almost wasn't going to answer you, looking at your id ;-)





True and luck or divine interference, whatever you want to call plays a big part too.....

I was told by my lawyer not to send any letter unless asked for. Otherwise it would get lost in the pile of papers. If they send a RFE then the letter (response) would be properly linked to the case or else tt would be difficult to link the letter correctly to the case.

I chnaged jobs in March using AC 21 and I got approved on 8 th May. I did not send any letter nor did I inform USCSIS about the change. I had actually applied for my EAD renewal 3 weeks ago. This may have prompted them to look at my 485 case. Acutally, My EAD renewal got denied 5 days after my GCapproval!

did you do anything apart from adding a letter while submitting I485?

My Attorney had filed my 485 with a copy the receipt notice of the EB2 485. We did not send any letter. You can TSC and ask them about it.. or may be infopass. The IOs have more more info than we think. They are just too lazy to look. For eg. I got luckly 3 weeks ago. I called TSC one time, and the IO said my I 140 was revoked. I told him that I have a second EB2 I40 he checked his computer and he said he would send my case to supervisor.
