Topic: How long does a Service Request takes to be answered?

My 140 was received on 10/02/06, RFE reply on 7/30/07, no responses from USCIS to date.
My lawyer sent an SR on 11/15/07, but no responses yet. How long does it take for USCIS to receive the SR and reply?

If you had a soft LUD on 12/22/07, please post the status of the application. It would be interesting so see if it is a system wide LUD or only on selected cases.

Topic: soft LUD on I-140??

I got a soft LUD on I-140 on 12/22/07. My I-140 is pending since a RFE reply on 7/30/07. Priority Date 4/30/01, received on 10/2/06. I am pretty sure the LUD happened on late afternoon.

I don't really know how it works, but I imagine that a soft LUD would happen every time there is a change in the immigration file. So if they add notes, log in time worked on the application, add fingerprints and FBI reports, it would change the LUD. But I don't believe it would change just by them looking at it. Well, this is just a guess.

Topic: Substitute I-140 in concurrent I-140/I-485, Can I do this????

I applied for I-140/I-485 concurrently to adjust me and my wife, My I-140 received an RFE about ability to pay and I am not sure that the company will be able to respond. My wife has an approved I-140 and will be able to apply for the I-485 on 7/1/07 when the visa is available.

Can I change my I-140 in this concurrent I-140/I-485 case for her approved I-140??? (this will save me money in filling a new I-485 and several months waiting)

Topic: What the heck is going on with I-140s in Nebraska?

In my understanding of the I-140/I-485 concurrent filling, the I-140 approval is the basis for the I-485 approval. So, I think it is impossible that the I-485 will be approved before the I-140. The good thing is that whenever the I-140 is approved, the approval of the I-485 should be fast due to the fact they say to be processing september cases.

Also, the Premium processing should take about 15 days to be approved and your date is current. I've seen cases at trackitt as well as other sites that has processed cases as such as september, which leads me to believe that someone should be approving your case right now. Maybe your certifying officer stop to grab lunch, talk to other employees, or is taking longer at the restroom break, but they will get back to it.

I personally wouldn't spend the time and money to seek Premium processing. My case is in Oct 2, 2006 and I am expecting to have that approved around 5/25/07.
