Topic: PLEASE HELP: Why our cases are messed up? .....

EduKondalaVada and RFEI140

Thank you very much for your earlier advice to me to take Infopass. INFOPASS IS THE BEST RESOURCE TO GET INFORMATION ABOUT YOUR CASE. I strongly suggest to anyone who is desperate about their situation.

I went to my infopass appointment today and shockingly noticed that our case has not even been touched since August 2007. The IO was also surprised when he saw our congresswoman reply which says "the case is waiting to be assigned to an officer". The IO said that our case was in inventory and not waiting to be assigned to an officer. IO also told me that he will send an email to Nebraska to ask them to assign my case to an officer. He also acknowledged that our cases were long long overdue.

I wish you two the best in your life. You were my more helpful than my attorney who sucks.

Good luck to everyone

Topic: PLEASE HELP: Why our cases are messed up? .....

We (me and my wife) filed our I485 (EB2-NIW) on November 7, 2006. We recieved a letter on March 2007 that our cases have been moved to New York local office for faster processing!!!!!!!!!!!! However, this was a complete mistake in USCIS system. Our cases were physically in Nebraska and only USICS computer systems were showing they were in New York.

After calling NEBRASKA more than 120 times, one nice IO finally corrected the error on July 2008. (Can you believe that for 1.4 years it was just an error???????????????????) Anyway, after a couple of calls and service requests and congresswoman inquiry, finally our cases got transferred to distribution unit (waiting to be assigned to an officer) on August 2008.

I have been calling Nebraska almost every week after that and they are telling me "your cases are ready to be assigned to an officer, however someone should pick it up!!!!!!!!!!!!!"

I contacted my congresswoman and sentaors and they all told me the same thing. However, for the last 3 months nothing has happened, and I am not sure if anything will even happen.

I ALMOST BELIEVE THAT OUR CASES ARE NOT EVEN PHYSICALLY IN DISTRIBUTION UNIT and this is another mistake in USCIS computer system.

PLEASE ADVISE WHAT I SHOULD DO???????????????????????

Hi,

Congrats. Very happy to see that you finally recieved your GC. I have also filed EB2-NIW with Nebraska on 11/07/2006 (around the same time as yours) and while our (my wife and I) cases have been waiting to be assigned to an officer since August 20, 2008, however, it has not yet been assigned. I am sure USCIS messed up our cases. I comletely lost my hopes to recieve my GC anytime soon.

However, I am happy for you. If you have any suggestions/advice for me, please let me know.

Good luck

Topic: Case transferred to NYC for faster processing

Hi

Here is my story:

We (my wife and I) applied I140-NIW/I485 concurrently on November 2006 and sent our applications to NSC.
On March 2007, we recieved notices stating both of our I485 cases had been transfer to NEWYORK CITY office for faster processing. On Septemebr 2007, we went to NEW YORK CITY office for status update and IO told us: "your case is not in new york city. It is supposed to be here, but it is stilll in NSC." She also said it was strange to her that the case was not in NYC.

My I140-NIW petition got approved on December 2007.Therefore, we called USCIS Customer Service and did a SR on December 17, 2007 for our I485 cases. Since we had not heard back from them on SR, I used POJ method to talk to IO in NSC. I talked to 5 different IOs and 4 of them told me that our case was not there and there were in another office. When I asked which office, they told me we can not tell you (and some of them told me we do not know).
The last IO whom I talked to yesterday, told me that to wait till March 10. They will post new information on USCIS web.

Have anyone faced this kind of issue so far? Any help and advice is appreciated.

Thanks
