Topic: 9th year H1 denied - please help

Hi All,
My Attorney has refiled my 9th year H1 Extn at Vermount Service Center on 11/10/2008, but as of today they haven't received the Receipt Notice. Does any one know how long it takes receive the Receipt notice. For all my previous filing, I got the receipt notice with in a week.

I am worried as my H1 was expired in May 2008, filed for extn before that and received a Deniel notice, and Now Re-Filed.

Want to know if VSC is delying the Receipt Notices for all or Any thing in particular to my case is causing the delay.

Topic: VISA BULLETIN FOR DECEMBER 2008 - OUT

Cleaning the older cases by not moving the dates is the BEST every one. But couple of monthes before the end of fiscal year they will move the dates farward by more than 2 years at a time and forget about the old cases and start approving without logic. Again a new year comes and dates go back. This is frustating but no way out except wait, wait and wait.

Surely you can apply for extension with in 30 days of expiration. My H1 got expired May08 and applied for 9th year extn before it expired. This monday I got a Denial notice, My attorney is preparing to Refile.

Topic: 9th year H1 denied - please help

Hi,
I just received the reson for Denial.

The location specified on approved LCA, at the time of filing the H1 Extn, does not match to the location of employment.

There was a typo while selecting the state. my attorney selected 'GA' instead of 'OH' and thats the reason.

My attorney advised to refile the case rather than appeal. [don't know the reason.].

Any advises or suggesstion are welcome.

Topic: H1B Renewal Denied.EAD and AP approved till next July! Am I out of Status

Hi atchayya,
On 10/28, my 9tyh year H1 and assocated H4 got denied. Haven't yet received the Denial notice. I just checked my portfolio and found a soft LUD on H1 and H4 [don't know what its for]. My H1 extn filed at CSC. I am guessing the same reason as yours for denial.

When asked my Attorney about my options, she says to wait tillt they receive the denial notice. My employer is willing to file MTR/appeal. Hey if you have any advice please let me know.

I applied for my I-485 in the month of Aug 2008 and there is no way I am close to Greencard approval.
We haven't yet received the Denial notice. I will update as soon i get it. I heard that we can appeal for H1 extension.
My attorney wants wait untill she receives the actual denial notice. If you guys know what are the best options to do for this situation, please let me know.

Thanks for your advice. I will update as soon as I get the deniel notice. While applying for exten I have submitted all the recent paystubs and last 3 years W2's. As JamesBB suggested, I will file an MTR ASAP.

As Kits94340 suggested, I have to be wathfull if DOL is scrutinizing the I-140 petitions filed by my Employer. By March 2009, I will be more than 180 days since filing my 485 and have consider invoking AC21.

If any one have any suggesstions please let me know.

I just checked the status of my 9th year H1 and its "Deniel Notice sent".
On October 28, 2008, we mailed you a denial decision notice for this case I129 PETITION FOR A NONIMMIGRANT WORKER. The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 30 days of the October 28, 2008, please call customer service at 1-800-375-5283 for further assistance.

I applied for I-485 this Aug 2008 and got EAD and AP for me and my wife. I don't know what to do but I am scared. Got RFE in Aug for H1 exten, replied in time and today its denied. RFE was about a correction in the petition. My H1 was in California Service Center.

Please suggest me on what to do?.

In mid Septemner I heard from my employer, that an Audit is going on as someone complained that he is not paying salaries.

Topic: Soft LUD yesterday........what that could mean?

My PD is also 3/28/05, EB2, India. My I-140 approved in July 2008 and applied for I-485 in August 2008. No LUD after finger printing.

Akshay, can you tell me if USCIS considers the Priority date or the processing date. I was stuck in PBEC and couldn't apply during July 07 fiasco. As you all are talking about eh PD movement to April 2005. I can't bear my bullying employer any more.
