Qualification is based on the spouse's H-1b status (and their I-140 status). It has nothing to do with educational qualifications of the H-4 beneficiary.

I am an Indian. I am on H1B and I have an approved I-140. I am switching jobs next month. So, far I have used 4 years of my H-1b. My new employer filed for a H1B transfer seeking 3 years extension since I have an approved I-140. My biggest question at this moment(assuming this proposed rule comes into action soon) is whether my wife, whos got a H4 visa currently, be eligible to get EAD even if my current/soon to be ex employer revokes my I-140 after I resign. I am sure there are some people out there who is in the same situation. It would be great If any one can shed some light into this peculiar scenario.
