I am not sure why BS+5 and MS+ 1year is not EB2. This is part of regulation and requirement for EB2 category. I believe both of your cases might have combination word in your labor which is not allowed for EB2. Again, for EB3 LC should not have requirement for advanced degree (here US Masters). I don't know how NSC is treating such type of labors which they deny EB2 since the LC has combination word but otherwise meets EB2 requirement and LC has Masters requirement which can not be approved as EB3. Let me find out the regulation and post it here.

Can you provide more details of your lc?

Congrats sarathynp!!! I think how big relief this is going to be to you. I am still waiting for my appeal that I sent to NSC 20 days back and it is still with NSC. I got evaluation from wes.org and ierf.orf which evaluated my iete to US 4-years BS and my MS from BITS to US Masters. Hope I hear positively this time.

Could you share the officer # who sent rfe/noid?

My Eb2 petition was revoked on education grounds on May 8th and we replied on June 9th and received by NSC on June 10th. We put lot of new evidence and more evaluations and nice covering letter. Hope I get approval this time. I am supposed to be eligible with both BS+5 years and MS+3 years ground. Since my attorney didn't reply properly to intent to revoke letter and I believe, officer already made up his/her mind to deny the case, and it was revoked.

MTR filed: 06/09/2008
MTR Received by NSC: 06/10/2008
I290B Receipt notice received by us: 08/18/2008
LUD changed on I290B: 06/16/2008

Additionally LUD changed on my pending AP with the same date 06/16/2008

I don't know why AACRAO said that it is equivalent to diploma as if you are short of diploma. But you should go ahead get the evaluation done. It is taking 6 weeks and since all revocations have only 18 days time to appeal.

But I strongly suggest get it from AACRAO immediately.

Another trap - When they revoked my I140, NSC gave 33 days time in the denial letter. I saw another appeal case, where they received same 33 days time for revoked I140, they reply received on 28th day by NSC. But AAO, rejected the case saying that the appeal is not filed in time since the regulations say it 15 days for revoked case though the NSC officer made a mistake giving 33 days. That is it is not their fault. I already crossed 15 days and I am sending it tomorrow which would be 30th day.

So USCIS made two errors, and finally they are blaming us -- one is approving the petition in error and later revoking it, and second one is sending the revoking letter with wrong information -- But everything is blamed on us.

We will wait and see what happens. I am mainly using it to extend my H1 and also relying heavily on the officer decision who denied my case. Looking at the way he rejected both my cases, he seems to have already decided to deny it. But we don't know and there is a word called 'LUCK' that may turn it around.

To answer your question:
No, they don't need the syllabus. I believe you will be having memorandum of marks. I am sure the guy who got it from AACRAO with AMIETE, got it as equal to US BS. Mine is going to take more time and not expecting it any time soon and hence can not attach it.

It seems that AACRAO is recognizing AMIE to degree and they know in/out of these degrees. So, I would strongly suggest to go ahead get evaluation from AACRAO.

I still need to get evaluation report from them which may take several weeks after I submit my appeal. It may not have any use for me, but I saw in few places where USCIS give more weight to AACRAO's evaluation and they did equate AMIETE to US bachelors degree and I don't see any problem for AMIE too. I would like to see your case approved, but expect bad things from NSC and be prepared with the evaluation. Request the evaluation today itself and if you can, get it from WES too. I don't think WES and AACRO differ on the evaluation.

Sorry! for the confusion. Let me take it back. If you have masters requirements in Labor, it can not be EB3.
