AmandaUk is absolutely right that lawyers actually delay the process. In some cases, they may even jeopardize the process... for example, if they go out of business, or change their addresse while forgetting to notify CIC... or just don't get your CIC mail to you in good enough time for you to respond to CIC... I've seen that happpen.

If you are at least 16 points above the 67 cut-off points, then yes, I'd advise you to write a letter telling them you will not take the test like becomingGandalf did, or write letters supporting your 'English Skills'
HOWEVER, if you know you need all your points, then simply do not gamble but instead, comply and take the darn test. The test is easy for skilled English speakers, it's relatively inexpensive, and best of all, it secures your language points!
If you do not take the IELTS, you are essentially asking the Officer to use THEIR discretion (or mood) in awarding you points. I have seen cases where US PhD holders were awarded anywhere from 0-8 points - per discretion ie depending on the IO's mood. The net is that, there are times in life to haggle, and there are other times to simply comply - to your advantage.
I grew up in an English speaking environment, completed education in an Ivy League, yet I complied since I don't want to play with my points for the FSW. I took the test so that it is not left to discretion or PMS or something like that....

It's very easy to do by yourself. Typically, people only use Lawyers or consultants if they have a complicated case - like a previous criminal record, or failed asylum case or something...
Unlike the US one which you have so far successfully done, the Canadian one is extremely straight forward, and so easy to put together yourself that it is somewhat dummy-proof if you follow instructions well.

Yes, you and your wife are separate individuals so you will need two cards for FBI. One for her, and one for you.
You will also have to do same at your Indian consulate one for you, and if she has ever lived in India more than 6 months since turning 18yrs, one for her as well.
Some people quickly lodge their applications (even though incomplete) to get a place ahead in the line.... They don't take the IELTS or get their fingerprint clearance done first. I too frown upon this :(

Hi There. Do not fret. The exact same thing happened to me TWICE before I finally lodged a successful application.
I too came as an F1 student.
Simply resubmit your application WITHOUT responding to their letter that says proof of lawful admittance for 1 year...etc
Resubmit your application fresh as you may have had an inexperienced processor initially. This time when you resubmit, make sure you include a copy of your I-20, the stamped I-94 card showing your status changed to F1, any F1-visa you have, as well as if possible, a letter from your International Students office saying that you are/were an international student at their school.
Then resubmit.. you will be successful. Good luck!!
PS - I tries to respond to explain that I was indeed admitted to the US for at least 1 year - per instructions but the file was returned again. SO I said dangit, and resubmitted a fresh application that had no signs of it being previously processed. I instead just re-submitted, but this time included a letter from the school. |
Topic: Can I canada using PR card after absent from Canada for 3 years
You will have a problem if you have stayed out of Canada past 3 years. The reason is that Canada requires PRs to spend at least 2 years out of every 5 years in Canada. Since you left Jan 05, there is no way you can establish a residence of 2 yrs within the last 5 yrs... so they most likely will reject your entry, and PR status. That's what typically happens.
