Thanks Kansas for the quick reply.

Can you briefly points me the advantages/disadvantages of H1 over EAD? The reason I ask is, if using EAD sounds riskier, I would better apply for my H1 right away irrespective of my 140 approval.

Hi all,

My H1B is expiring soon in Jan. But I am waiting on my EB3 140 (@NSC) to be cleared so that I can awail a 3 year extension on my H1B. I also have my EAD available and have never used it.

Given the scenario

1. Is it safe to allow the expiry of H1 and switch to work on EAD until 140 is cleared?
2. Once 140 cleared, can I again apply for my H1-B and technically back to work on H1(although I might have used EAD for a while)?
3. Is there any other thing I need to be aware of?

Will USCIS approve a 3 year H1B, if after the H1b application is made and the 140 subsequently is approved during the processing ( 2-3 months) of H1?

My EB3(Ind)- 140 is pending at NSC with RD of Jun-15, 07. With the current trend of 140 approvals @ NSC, I am expecting my petition to be cleared by the end of Jan, 09 or atleast Feb 09.

My H1-B(9th year) is about to expire by Jan 19, 09 and would like to extend the same. While it is logical to wait until the last moment before applying for the H1 extension(hoping for 140 cleareance), to get a 3-year H1 extension, I want to know how long (in terms of date) should I wait before the H1 extension.

Also, more importantly, will the USCIS issue me a 3 year extension, if my 140 is cleared during the the H1-B processing time? (i.e after the H1 application has reached them and before the H1 is approved)?

You can take a infopass appointment and explain your situation. They might refer or sometimes do the necessary changes to your PD.

1. Can I post all 4 application on one envelope(Fed-Ex)?
2. Online or paper application.. which one is the best and fastest option?

I hope your employer is a not typical desi company. It costs a letter head, envelope and a 42 cent stamp to add the date and send you the EVL with the start date. I am guessing what happened might be that they have already given you the EVL and don't want to do this huge painful job of giving you one more EVL. Lazy bums and cheap rascals.

Try to push them to give you the EVL with the date, but don't wait on it too long though.
