Hi

My husband is entitled to EAD but he did not apply for one Would this be telling immigration that he is working without paying taxes? He is here for more than five years under my H1B. Also can one apply for the EAD independently of an attorney?
The fees are so high!



I do not think it should be the case, that they automatically assume that your husband to be working illegally. I am not sure about the second question. You can start new thread for it.

Yes I opened emailed this morning and I had 2 emails (one for my case and one for wife's), welcoming new permanent resident. I had 3 soft LUDs, March 5th,6th,7th then today the case was approved.

Thank you for sarcasm. BTW I have no problem people who applied earlier than me (like you) getting green card first. BTW my priority date is current, and I am also outside the processing timeframe.



Don't take it seriously. I was joking. It is your right to get your GC. If they are delaying the cases , it does not mean that you should be quiet. Every information and every call that anyone reports is a good piece of information. I hope you get your GC very very soon. Don't lose your hope based on that call. Don't be surprised if you get your GC today !! I jope to make the waiting period a little bit fun.

Me: Hi, I want to know if you process applications on first come first basis
Agent: No, its based on PD and processing times
Me: Ok, how come other people who applied (I got cut off here)
Agent: We are not going to talk about other people, what is your receipt number:
Me: ******
Agent: Sir, your case is pending namecheck, and there are cases thats been pending since 2003 or 2004, so it would be a while till we reach your case
Me: Ok, that means there is a separate queue for people whose namecheck is pending and (got cutoff again)
Agent: Sir, you keep talking about other people, there is no separate queue.
Me: Then how come people who applied in June/July 2007 are getting approved
Agent: They somehow slipped thru the system, thats all what I can say, right now we have backlog and we are working on them, only when we clear backlog we would process recent ones
Me: Do you have any timeline for clearing backlog
Agent: No, we would get memo that it is clear and then we can work on current ones
Me: Thank you

(and I slapped the phone with nice curse words afterwards for her)

Topic: Interesting conversation with IO

I called TSC again using POJ. (My case again is outside of processing time). So here is how conversation went:

IO: How can help you
me: My case is outside of processing time
IO: what is your receipt number
me:
IO: Your case is pending
me: (duh in the heart), yes maam what is the hold up
IO: No visa available
me: But, I am current
IO: Current does not mean visa is available
me: but current (and I get interrupted)
IO: Sir I told you your status (I felt she is going to hang up)
me: (quickly) ok can you tell me if my namecheck is clear?
IO: No
me: thanks

Although approved card would make me quite happy, but this conversation was quite enjoyable, so just wanted to share it.

Topic: Case under review

I made SR 3-4 weeks back on basis of case out of processing time, and they said we will notify you in 45 days. So I did not want to call them again, and since I saw LUDs, I thought I should use POJ to find if that was name-check. But lady said case is under review and name-check still pending, so I assume those two LUDs was caused by SR, not name-check clearance.
