Yes I am from Pakistan. Born in Pakistan.
Even though I am canadian citizen (naturlization) working in USA, but my country of of birth is Pakistan. My application was submitted as pakistani.
I am in EB2, which is all current for Pakistan. I know for Indian EB2 is retrogressed (08 Jan 03).
Infopass immigration officer told me, his system says Name check / Back ground was completed on Feb 17, 2006.
There has been no LUD since Jan 2, 2007.
This is a prime example of how Name check / Back ground check is being used as an excuse for everything. |

EB2 case pending in Nebraska.
Receipt date of June 26, 2006.
I-140 Approved in December 2006.
Regular processing, concurrent filing
Last update on my case is January 2, 2007
This is what I have done so far.
Called up USCIS customer service center (800 numbers) in March and put in a service request. Got an answer which says “waiting assignment to an officer". Any one can explain to me what does that mean?
Today I went in for Infopass.
Officer at the infopass looked up my case and said you are all set. I asked him what does that means? Is my FBI name check / back ground check done? He looked it up on the computer and said..yes it was done February 15, 2007
So I said I am all done. He said you are all done.
I asked immigration officers so how long before I see approval for I-485. He said as soon as your dates become current. I said what do you mean date becomes current, because I am current. I am in EB2.
He said No, look on USCIS web site when it says they are processing applications from your time. I said my dates are current. He said wait 30 days. I said I am passed 30 days. Officer said really? I said yes really. So I showed a print out of case status service online from April 18th, 2006 for Nebraska center. It says "I-485 employment based processing date September 11, 2006". My application is June 26, 2006.
At that point the immigration officer said, let me call Nebraska and check what is going on. So he called and he was on hold for 10 minutes and then he talked to some one and then he hung up the phone and told me, your application is still in the back ground check.
I asked the immigration officer that you just said back ground check is done. He said yes my computer says it’s done but Nebraska told me your back ground check is not yet done. Sorry, that’s all I know.
Now my questions to all the immigration gurus on this site is. Can some one answer, where am I stuck? What does this whole thing means? Is my FBI name check / back ground check done?
Your help would be greatly appreciated.

Topic: USCIS using background check as an excuse?
Hello
You said you got a reply back saying "your case is being delayed due to FBI name check / Back ground check".
Did you do a service request by calling the 800 number?
Did your letter stated that "your case is being delayed due to FBI name check / back ground check"?
I am asking this because I did a service request by calling 800 number and my letter says "my application is awaiting assignment to an officer".
As you can see from my trackit, I did concurrent filing in June 2006. Regular processing, EB2. Got approval for I-140 in December 2006. Last update on my I-485 online is Jan 2, 2007.
I still don’t understand what does "my application is awaiting assignment to an officer" means? Back ground and name check is done? Is USCIS so busy that they can't assign an officer to my case since last year June?
On the other hand you can see from Nebraska processing times that I-485 from September 11, 2006 are being processed. How did my I-485 got missed.
Any one who has any real experience, if you can answer my concerns / questions it would be greatly appreciated.

Thank you for agreeing with me. I agree with you too.
This is what makes me so sad. We supposedly live in one of the most technologically advanced country in the world. One of the richest country on this planet and we can't get a predictable "Name check / Background check" process in place? We all pay fee and we will probably pay more fees in future for all our USCIS applications and still USCIS can't implement a predictable process of "Name Check / Background Check" in place.
This 6 month service promise is a joke. Just look at trackit and see how many 485 are approved in 6 months (may be not even 50%).
Even when most of us do infopass and services request at USCIS, you don’t get a precise / clear answer. Most of us get a "clear as muddy water" answer. Where a lot is left for you to interpret ate yourself, however you want to interpret ate the answer. |
Topic: FBI name check
This is the main problem. No one knows how this works. When does "Name Check" process is started and how it flows thru the process.
The way I think, this "Name Check" should be a very well defined process. One should be able to follow it to on a day by day basis. One shouldn't have to guess. Where as in reality it’s all guess work.
Some people who get there Green Card in two months say I did this and that and that and that’s why I got my 485 approved in two months. Then on the other hand there are cases where people have done the same exact this and that and that and they have been stuck in "Name Check" for years.
I personally think and believe its all "Luck". How lucky you are. It's all guessing game at this time.
Where as in reality it should be a first in first out basis. This entire "Name check" should be a documented procedure. One should be able to follow it on a daily basis and all the guess work should be taken out of it.
But if the guess work is taken out of this, then people would have a certainty. If there is certainty and process is documented then that causes a bigger problem for USCIS. People can hold them accountable. So the more uncertainty and more guess work there is, that means less accountability.
Now I will finish here. I will let you make your decisions. |
Topic: Interpretation of service request
Hello All
First some of the background info:
Concurrent filing I140/I485 in June 2006 under EB2 category.
Filing center / Processing Center Nebraska
Finger printing (biometrics) done in August 2006
EAD and AP granted in September 2006
I140 approval in December 2006
LUD on my I485 was on January 2nd, 2007
Called USCIS couple of weeks ago to check on my application status and put in service request. This is the response I got back.
"Your application is awaiting assignment to an officer. You will be notified when the decision has been made or if additional information is needed"
Can someone please explain to me what does that statement really means?
Has the FBI Background / Name check already done and all is ready to go?
Once this application is assigned to an officer, he / she can simply approve / deny this application?
Once this application is assigned to an office, he / she will send it over to FBI for Background / Name check?
Your help will be appreciated
