Hope ur PD becomes current soon for you and you get your GC - all the best.

Looks like USCIS is pre-adjudicating many cases and putting them in the shelf.
My wife filed as a dependant to my 485 (PD - Jan 2006) got HARD LUD today last week after responding to RFE- then she had soft LUds day after that and today as well.

I am not expecting her GC or mine anytime soon- might expect some magic next year around July though.

Great Post man!!! You took the issue right on and came up with right material to address it.
The Murthy link is really helpful to all.

The typical reaction of anyone if he gets one such Card approved in error is - sit back and relax,but after reading this,one should have a backup plan ready in case,USCIS decides to rescind the GC. Good for that guy- he had Murthy's firm work closely with USCIS on this.

This is interesting. So many conflicting theories on assignment of VISA number - some say not assigned till case is approved while others say it is assigned before RFE is issued etc.

srkr's post supports the latter.
I had seen many people post about RFEs on their cases about couple of weeks back.
Any updates on their cases? Anyone with RFE in last 1 month got approval?

Or Could it be people are getting approved after RFE,but nobody updates on trackitt once they are approved.

I saw LUD on my and my wife's I 485 today...Does that mean anything positive is going to happen in coming days?






he is EB2 ROW - cross charged to Pakistan. So,PD is current.

Topic: News from Senator's/USCIS Office - Long tough road ahead ...

It is a quiet possible scenario,unless there is some VISA number rollover from Family category to EB2.
But in that case,what suprises me why are so many people getting SOFT LUDs and RFEs for India with PDs in 2005/2006.
I got one too. My wife got an RFE too.
Why are they pre-adjudicating cases if they are not going to approve it anytime soon?

Going by Gogreenwithgc's post,doesnt seem like EB2 2005/2006 PDs are going to become current anytime soon.

For affidavits made in India,Indian law requires it to be on Rs. 100 Stamp Paper.
Only then Indian Notary will notarize.

If you are getting the affidavits in US and parents are here,then you can do it in 8.5*11 normal paper and get it Notarized here.
But if you are doing it in India,you should do it in Rs. 100 Stamp Paper (Non-Judicial).
Also,I had submitted 2 affidavits from my parents. There must be one affidavit ,each from Mother and Father.
Also these should be Notarized there.

Topic: Birth Certificate with incorrect name issue

Hi Folks,
There is an issue with my wife's Birth Certificate.
She has wrong Name on it.

For her I485, we were thinking oif submitting a Non-availability Certificate(NABC) instead of going through Name Change Process etc.
But since her birth is registered with a differnt name,we wont get a NABC.

So,has anyone been through same issue?
What if we get an RFE for that?

I have already sent Consulate BC and affidavits from her parents,but I am sure USCIS will ask for her BC or NABC.

Is it ok to send this BC with a different name and explain to USCIS,that the name was incorrectly mentioned and we are in the process of having it changed as per process and that we have other documents like her school,college certificates,PAN no. etc to prove that?

Any comments/suggestions will be helpful.
