Topic: Layoff, after I-140 approved

Update your details. Try get into a company with similar job. Since your I140 is already approved, if I485 application pending more than 180 days go-ahead and invoke Ac21 with new employer. Once you invoked Ac21 your present employer can not revoke your I140. Whatever it is act fast. Request your current employer for a possible extension may be one or two months which will give you a buffer time. Goodluck to you.

Topic: REF and visa unavailability

As per my understanding, IO will assign a visa number as soon as he picks a case. So he might have assigned the Visa number before sending you the rfe itself. Goodluck to you.

Topic: Changing from EB3 to EB2

I agree with PKGCWAITING. I know few cases, their already approved EB3 I140s got revoked
when they trying to move to EB2. So be caution on whatever step you take and discuss with good attorneys.

Topic: Employer doesnot respond to RFE, then ...

drobg, since I140 is your employer's pettion it is always safer to change the employer (even a H1B transfer) once it is got approved. Since you already crossed 180++ days on pending I485 application there wont be a problem in changing employer after I140 is approved. Since your I140 is pending so long and your current I485 is current (i think so) there might be a chance that your I140+I485 both will get approved at the same time. Ask your attorney if he can talk to USCIS. Goodluck to you.

Topic: Employer change of address

what is the address you are given in I485?, as long as it is your's or your attorney's address then there should not be a problem (since your I140 is already approved). Again it is a common procedure that the employer should inform USCIS about his address change bcoz there is a chance for missing-out any communition from USCIS on his anyother pending applications.
