10/24/2007: Reinstatement of H-1B Status for Returning H-1B 485 Applicants from Overseas Trip in Advance Parole

* There are and will be some H-1B professionals who have to travel on Advance Parole rather than on a H-1B status because of their special circumstances. This includes unmarried professionals who need to maintain a H-1B status so that they can bring their future spouses to the U.S. on H-4 status and apply for the green card process. Under the current USCIS policy and laws, these professionals have two options to reinstate their H-1B status. One is to leave and return to the U.S. using a valid H-1B visa in the passport. This option is available only when they have a valid visa in the passport to return. Second option is to file I-129 H-1B extension petition. The second option does not require the professional to leave the country to reinstate the H-1B status. They can just reinstate their H-1B status within the country. When they take the second option, they should make it sure that they file the H-1B extension petition while their current approved H-1B remains "valid." Accordingly, when they apply for the H-1B extension, they should submit a copy of parolee I-94 together with the valid approved H-1B approval notice.

Dependent(my son's) I485 application rejected due to incorrect fee. My PD is Apr'2007 which is NOT current. Can I resubmit my son's 485 application fee now.

Topic: Son't I485 application rejected - incorrect fees

My son's I485 application was rejected due to incorrect fees. Do I need to wait for my PD to be current to file his application again. OR, does PD not matter for dependents, if primary's application already went through.

Any suggestions/help will be greatly appreciated.

Topic: Trying to add my 485 receipt number to my portfolio: Customer Portfolio Insert Failed

The only receipt that I have been able to add in my portfolio is for I-765.

I applied for my 485 and 140 together along with 485 application for my son and wife. Also, I applied for AP, for all three of us and EAD for myself and my wife.
I received -
# All my receipt notices.
# All receipt notices for my wife, except for EAD.
# None for my son.

Looks like there is lot of inconsistency in issuing receipts and enabling receipt numbers to be viewed online.

I'm trying to add my 485 receipt number to my portfolio, but I'm getting the following errors -

Validation Error(s)
You must correct the following error(s) before proceeding:

* Customer Portfolio Insert Failed
* Attempting to add a case that does not exist. Check the app receipt number.

I485 application wasn received on August 17, 2007 and the notice date is October 13, 2007. Is anyone else having similar problems?

08/07/2007: Certified PERM Application (ETA 9089) Filing Advisory With USCIS

The hard copy certified ETA 9089 is printed on a light blue color papers by the DOL to certify that it is the original. In filing I-140 petition, the employer is required to submit the original. However, in certain situations, the original is not available to the employer for a number of reasons including loss. In such instances, under the long standing agreement between the USCIS and the DOL, the USCIS can request and obtain a duplicate from the DOL.
It has been a practice with the employers, aliens, and attorneys to print out a copy of PERM application at the time of online filing and once they received the certified ETA 9089, they just make a copy of the employer/alien/attorney signature pages for their files adding other pages from their file copy which they had kept right after filing of the PERM application. People should cease such practice immediately. The original of the certified labor certification application is not only distinguished in color but also the certification of validity period at the bottom of each page, which they started after July 16, 2007. Accordingly, unless the copy shows the validity period at the bottom of each page, it is not a valid copy of the original. Accordingly, people should make it sure that as soon as the hard copy of the original certified application is received from the DOL, they immediately make a copy of every page and keep it as a valid copy of the original certified PERM application. IMPORTANT, IMPORTANT.
