Topic: H1B - Grace period 60 days - Transfer to other company

I am not quite sure what is your issue with the company where you are resigning without having another offer in hand especially when you are on H1B visa whose sole purpose is to work with a sponsoring employer.

Do not play with the 60 day rule as this is a one time thing only and it was developed to protect in the interest of people who gets terminated from their job being working on sponsored visa.

There are always a chance that you may not get extension so play safe.

If attorney's did not received any updates and there are no updates yet after 15 days, they must contact USCIS for an update. This is why they paid PP service fees for.

According to your timeline of RFE response, today is 13th calendar day thus 2 more days you have to wait before asking USCIS for an update (assuming you said your case was filed in PP).

Yes, all PP cases get email notifications directly sent over to attorney.

A successor of interest will be required for your approved I140 and H1B amendment will be required to file under new company name showing and proving the merger.

I am guessing you are now working for Employer B on a receipt notice and no approval yet.

You can move to Emp C however you must have a valid I94 not expired. You cannot submit a non-approved petition for a new H1b transfer

Yes both are separate H1 thus they have nothing in it to not go parallel.

Your employer B can file your H1 and you can join them upon approval while your extension is pending/approved. Even both are approved, H1B tranfer and extension, you can chose what to do next, you can either stay with Employer A or join B.

You can go for your transfer with Employer B. You still have valid I94 and thus applying for another H1 from employer B is no problem - just apply in premium.

Just checking in to see if someone can direct me to the right path here. I am planning to travel to India and will be required for visa stamping. I do not have a valid US visa so which counties I have to avoid as transit while booking airline tickets. Is Munrich Germany also require a valid US visa while going back from US to India?

This is what mostly happens in regular filed cases however there must not be a gap in your I797 I94 dates thus your attorney must ask for an update from USCIS on the date gap and they must go back on dates to fix it.

I highly recommend to upgrade your case to PP. The more you wait you lose more options for yourself.

In the event your petition gets denied for extension which I hope not as you responded to RFE, the only option you have is either immediately join employer A back or find employer C to transfer H1 again. In later case, since your I94 is still valid, you may be allowed to get extension without going out of the country.

First of all, USCIS tracking system is not 100% reliable when it comes to status updates. The day and time does not necessary means exact sometimes. It is suggested that your attorney/employer reach out to USCIS for further explanation.

Since the underlying source petition was denied for EAD extension, you will most likely either receive a RFE or denial. Thus if your spouse H1B is being refilled, then you must refile EAD with new receipt numbers.

Your I94 expired well over 240 days and you are out of status friend. Talk to your employer and attorney and ask them contact USCIS right away.

The right process is to to visit IRS local office and fill a small form to merge both ITIN and SSN. This is a required step once a person receive SSN, it is even mentioned in ITIN document. To avoid any future issues, everyone must inform IRS about this change.

If your I140 is approved is past 180 days from your resignation date with Employer A, you are absolutely fine. You can use your old I140 to transfer your H1B to Employer B and can port your old PD when your new employer files for new i140. Even your new employer takes 18-24 months to apply for new GC, you are good as far as my first statement holds true in your case.

Topic: Employer and employee in different states

Remotely working is absolutely fine as far as it is mentioned in your H1b petition. Your employer may be in a different state and your address of employment could be different state, however this address must indicate your home address from where you are working. Same information goes into your 485 details. Consult your attorney as well.
