She has U.S visitor visa but I dont want her to come here and stay 90 days and then apply for I485 based on approved petition.

I think the best way is, apply for I824 as soon as possible and request an interview at Canada consulate. I think you she does not have to go back to her birth country as long as she has supporting docs.

I think Canadian consulate is more faster than Pakistan.

My I485 application was filed in September, 2006 under EB2, and got approved in September, 2008.

I did mention my spouse name in 485 application and I was told that once my application gets approved, I can bring my wife on Immigrant visa.

Currently, my wife is in Canada working for big employer since December 2007.

Now she has 2 options;

1) Apply L1 in January 2009 and file 485 on the basis of approved petition.
2) Apply form 1-824 and wait for the approval.


I NEED SUGGESTION FROM EXPERTS;


Which is the safest way; L1 or I824?

Hi,

As per my understanding, case will be adjudicated once the name check got cleared.

When I contacted my senator back in May 2008. I was told that my case is pending because the name check is not cleared. They also said there is no 180 days formula. I DONT KNOW WHY?

You should get notification within a week or so.

My name check got cleared on July 15 (info pass), then I contacted my senator on Aug 05 and let them know that my name check got cleared and visa no is available for EB2 rest of the world. She was very helpful and sent an email to TSC about an update on my case.

On Aug 15, I recieved a letter from my senator that your case will be assigned to an officer within 30 days.

On Aug 27, I called TSC via POJ and I was told that my case is with an officer and you should hear very soon from us.

On Sep 18, I called TSC via POJ and I was told that there is a good news, and you will hear within week from us.

On Sep 23. I received card production ordered email.

My case was assigned to an officer on Aug 25 and approved on 23 Sep.
