My PD is 15-JAN-2011 for EB2-India

I DONT EVEN dream of GC :-( but realistically when do you think AT LEAST 'EAD' will be available for EB2-India PD January -2011 ?

Seems like a question that you guys can answer with sympathy.
I am not looking for Green card but when should EB2 I with PD 15 Jan - 2011 be able to apply for EAD ?

The chart for filling EAD (DATES FOR FILING OF EMPLOYMENT-BASED VISA APPLICATIONS) is stuck at Feb-08-2009

Any help is much appreciated.

I AM NOT A LAWYER BUT CONSULTED LAWYER FROM MURTHY by paying $$$$ for 20 mins WHEN MY S***HOLE (LOL) LAWYER from MY PREVIOUS COMPANY DID THE SAME :

Basically, for new I-140, USCIS does not even look at your porting date and it comes into play only when you are ready to file I-485. So, chill for now. As and when your PD becomes current, please do not forget to provide a copy of your original I-140 showing that PD.

Thanks for replying back. for me it was not a huge salary jump anything. it was for 1) chance to work with latest technologies 2) brand name . However none seemed bigger than immigration as I expect a PD of Jan-2011 to get at least EAD by Summer of 2019. It would be too much uncertainty to join them now and then again within 2 years finding a new employer who would apply in EB2. Therefore, I declined the offer.

How Difficult It is to 'Port' from EB3 to EB2 . And if the 'Porting is successful, can I keep my 'old-old' EB2 priority date of Jan-2011 ?

I am in a situation where I am offered a new job with a Fortune 100 company.

Catch is, for my new company will process GC in 'EB3.'

I already have an approved I-140 in 'EB2' with BS(from India) + 11 years of progressive experience.

My PD is Jan-2011.

Please advice, how risky it will be to go from EB2 to EB3 ?

Should I reject this offer because of this ?

Gurus, friends, please let me know what should I do ?
The offer is good with challenging software development but 'demoting' from EB2 to EB3 looks scary.

Any advice is highly appreciated.

Can not find any pattern in DOL processing is it grouped by 1) Priority Date 2) Company size/name/reputation 3) State ?

Topic: Change employer with approved I-140

A few facts/trends for people trying to change employer beyond 6 years of initial H1B stay

1) If you are not directly going to work for a product company or an FTE of an American company ( example : Microsoft, Walmart,JPMC etc-- Full time), Your H1b Transfer will be only for 1 year.

2) To elaborate point 1. If you are going thru consulting route in your job change ( Even for big consulting firm like Accenture,Deloitte,CSC etc) YOUR EXTENSION/VALID PERIOD after transfer will be only 1 year even if you have a valid I-140

3) Once you join that new Job, you new employer has to start GC process again starting from PERM.

4) PERM prep with advertisepent, PWD takes around 3-4 months

5) PERm approval from the date of filling is taking 150-180 days( If not audited)

6) So if everything goes well you have to spent at least 10 months out of 12 to get PERM approved and then you will be ready to file new I-140 and on its approval another H1 extension.

7) In case things dont go smoothly , you have no valid H1 after 12 months and need to leave US of A.

Is it worth taking this risk :

Yes , if the new job is really a big upgrade on your current position( in terms of Money or career or both)
AND
IF YOUR NEW EMPLOYER WILL SUPPORT YOU IN CASE SOMETHING GOES WRONG AND YOU HAVE TO LEAVE USA after 12 Months.
