folks,
I called USCIS last week about the status on my I-290B with my 290B receipt number to check the time lines on that type coz nowhere they get posted. That lady said, they usually take 60 days and I should hear any decision made by August 9th. (MTR filed on June 9th to NSC).

My Info:
Application Type: I290B, NOTICE OF APPEAL TO THE COMMISSIONER
Current Status: Case received and pending.

Does anyone know the info on how they do on these? do they deny majority of cases?
My only other option will be to start over on I-140 which means that all my I-485/EAD/AP will be no good. I hate that to happen.

I am crossing my fingers :-(

Also, does any one know that we can do anything about this? on the I-140 denial letter, they misspelled my name.

Thanks for the detailed post. I hope that everything comes out good for you. Good luck with that.

This is what my attorney put as an additional information with additional other documents on MTR:
"if this petition(eb2) can not be approved then as an ammendment not only in the interest of the petetioner and beneficiery but also in the interest of Service since the petitioner would otherwise file a new petition on behalf of the beneficiary and additional adjustment of status applications could be filed by the beneficiary and his spouse. The additional filings will result in increased adjudicative burden for the Service only to achieve the same result as the requested ammendment"

Does anyone know if chances are there to get either Eb2 or Eb3 approval? and how much time will be the turnaround time for this? If I know for sure this is not going to work, then I will be on my backup plans to have a fresh everything.

I appreciate everyone's thoughts and help.

The reason my I-140 was denied was that, my labor said Bachelors with 4 years exp or masters with 3 years exp. 140 was filed under EB2. Actual denial notice said for EB2 classification, there should have been bachelors with 5 years of progressive exp. So i think that my case sholud have been Eb3 to start with. But my attorney tried to convience for EB2 only with proper documentation. so he filed MTR for this one. I hope that something positive comes out of this.

May i know your reason for denial?

I-140(EB2) was denied on May 8th, 2008. MTR filed on 9th June. I-140 status didn't change.
