I am not an expert by far but what you describe doesn't add up at all.

First, it is nobody's fault that your job description for the GC application is different than your current duties if there was good faith when the LC was applied. In this fast changing markets it is almost impossible that you don't evolve within the company that has hired you.

Second, when they submitted your LC they sent all your credentials making you the qualified person for the position they offered you. You complied with the offer because you accepted it, and you continue honoring it as you continue to work with them regardless of the position and/or duties as long as you continue working on the same "area of expertise" you were hired for even if you were hired as a programmer and now you are a QA (example).

Talk to your HR and let them know that unless they want to cause you stress, ulcers, headaches and other related problems there is no reason for them to do this.

Again, the disclaimer: I am not an expert. If your employer continues threating you with this hire a lawyer for a consult and see your options while you get a new job.

Topic: FINALLY... Card Production ordered...On LAST day for USCIS to file response to WOM

I also went 7 months w/o LUDs or any other sign of "progress", but it only took a long phone call with an IO and then two days later the long awaited approval e-mail.

And the cards arrived only 1 week after this.

Whoa! this was fast. I got the CRIS' e-mails on Saturday 04/26 and the cards were on the mail on 05/02.

Is this fast or what?

I just went to the USCIS online case status page and got this message:

You are not authorized to view this page
The Web server you are attempting to reach has a list of IP addresses that are not allowed to access the Web site, and the IP address of your browsing computer is on this list.

Please try the following:

* Contact the Web site administrator if you believe you should be able to view this directory or page.

HTTP Error 403.6 - Forbidden: IP address of the client has been rejected.
Internet Information Services (IIS)


Is anyone experiencing the same issue?

Topic: Visa number per country

I think this is not a simple X,Y matrix.

The reason for thinking this is that if you read the section 201 of the Immigration and Nationality Act (INA) you see two different things for the employment based immigrants. One, the limit for employment based immigrants and second the limit of immigrants per country.

So, the number of visas available, can't be easily calculated (if you will) per country per sub-category (i.e. Pakistan EB3), because you have to take into account how many other immigrants are applying under all the other categories (Family Sponsored, lottery, Immediate Relatives, Refugees and Others), how many immigrants (total) are on the employment based category, how many are in the EB3 category and how many are in the ROW. The list can go on....

Also the way the rules are written allow the USCIS to shuffle visa numbers around. On the same section 201 it is specified that the number of visas is also determined by the number of "unused numbers" in other categories. The bad thing is that there is no place in this document that mentions what is the priority criteria to determine where the numbers flow from and where they go to.

As someone else pointed out earlier in this thread: be patient and be glad. The cases are moving along, some faster than others but they all are moving.
