Topic: Schedule a visitor visa appointment

My parents current B1/B2 visa is valid until 15th June. However they are going for their renewal on April 9th. Would there be any problem with that?

The reason they are going now is because my mother works and the earliest they will come is during Puja holidays (Sep-Oct), so they would like to be able to plan the trip and book their tickets in advance if they get the visa. They definitely will not travel to US before June 15th.

Please advise.

Topic: Schedule a visitor visa appointment

I have been trying to get an appointment in English at Kolkata consulate since the last 2-3 weeks but unable to get the dates. Once I did get the dates I wanted but when I started filling out the form where it asks for fathers name, dob and his mothers name, and hit enter the page started returning an error and I could never get to the next step. If someone has encountered the same problem, please advise how to work around it.

Also, do I have to get 2 different appointments for my mother and father, and what stage do I need to fill out the DS156 form? My parents are 62 and 60, so I assume they only need DS156 form. Is this correct? If not, please let me know what other forms.

Topic: First time travel on GC

I am planning to travel out of the country and re-enter using my Green
Card for the first time. I got the GC through my husband as derivative
spouse.
I recently got my passport renewed (Indian PP), but the consulate
officials did not endorse spouse name on the new PP. My original
passport was issued when I was single and I had been on my own F1 and
H1B, so never had any problem. This time I am planning on traveling
alone, and since my GC is spouse based, will I have a problem for not
having my spouse name on my new PP? I had specifically requested SFO
consulate to include my husband's name but they did not include his name
and basically kept it the same as my original PP. If anyone has traveled
under similar circumstances, could you please share your experience.

Topic: DS156 form

Can someone please let me know if it is okay to fill out DS156 form online multiple times? It generates a bar code, so is it a problem if someone finds an error and recreates the form?

I am filling out this form for my parents who are currently visiting here, and I would like to help them fill it out and carry the printout with them. Their B1/B2 visa expires in June, so they will be going for renewal sometime in April/May. I already have the visa fee receipt but cannot schedule the appointment right now because the consulate only opens up appointments one month in advance. In this scenario, is it okay for me to generate the form for them now, and give them the printout?

Topic: Visitor visa renewal question

I apologize for asking this question on this forum but would appreciate it if someone could answer my question. My parents are currently here in the US with me and will be leaving for India in the next 3 weeks. Their visitor visa is expiring mid-next year, I was planning on scheduling their visa appointment in Kolkata (sometime in March) while they are in the US so that I can help them fill out the DS156/157 forms, and they can carry the printouts with them.

Is it a problem if they schedule a visitor visa interview while in the US? Has anyone done this before?

Topic: At re-entry, how long does your passport need to be valid?

I am traveling out of the country on July 2nd and will be back on July 13th. My passport expires in June 2009. That leaves me with 11 months to passport expiry. Will I have any trouble with re-entry? I think the rule is for 6 months and waived for certain nationals, but I wanted to double check on this forum. Please let me know.

Well, his expires end of Oct 2008, and we come back on 13 July 2008. Besides, our AP is valid until Jan 2009. Also, since he is doing Premium Processing, his lawyers are not concerned at all. He works for Intel, and their lawyers have not started filing Oct extensions yet for anyone (they claim). Since we already booked our tickets for Europe, we better go!

I think your point is correct. That is why I think my husband's lawyers suggested that he apply for extension after returning from the trip since he will have close to 4 months after his return. So do you agree that it is okay for us to travel (we bought our tickets anyway!) ?

Even though my husband's I140 is pending (its an EB1-B), my I140 is approved under EB2 and our EAD/AP's are from my EB2 application, so I guess we should be covered under that as well? I had a terrible experience of getting stuck in Canada under TAL last year for 4 weeks when I went for my H1B stamping, that ever since I am paranoid every time we leave the country.

Thanks for your reply. In our case, the lawyer seems to think it is bad idea to travel with reciept and so wants to file after we come back since he has 4 months anyway. Also my I140 is approved, and the EAD/AP are through my application (with him as derivative). Common sense tells me shouldn't be a problem, but you never know with USCIS. Thanks!

My husband's I-485 and I-140 are pending, but he has an EAD/AP as derivative from my EB application (since I filed my 485 earlier). Also he has his H1B visa and I797 valid until Oct 2008. We are planning on going out of the country for a short vacation early July. Would he have any trouble re-entering since his I797 and H1B visa will be expiring in 4 months?

His lawyers are going to file his H1B extension through PP but they said they would wait until he comes back from vacation. Has anyone travelled w/ an extension reciept or should we just file the extension once we come back?

I know it is an off topic, but would appreciate a response. We need to buy tickets and get our tourist visa asap.

In our case we got a 2nd FP appointmnet with code 2. Has anyone has this experience?

I had applied as primary in July 07 under EB2 and had FP's of both of us taken (code 3) in Oct 07. In Feb08, my husband filed as primary under EB1 (without EAD and AP as we already had those from my AOS), and have been called for FP with code 2 on 13th May. Does this mean anything? I am hoping they have our cases consolidated since all our notices (even the EB1 ones) use the old A# from my EB2 application.

Any thoughts?

Has anyone got soft LUD on their I-140 this weekend after the server update? I got one on 12/22 on my already approved I-140. My I-131 was approved on 12/19 (soft LUDs on 12/19 and 12/20) and called NSC to confirm AP approval.

I just called NSC and found that my AP was approved on 12/19. We got soft LUD's on 12/19 and 12/20. However, she said it may be a few weeks before the document actually gets mailed to my attorney.

Topic: When traveling on AP, Do we need Transit visa?

I am travelling through UK by British Airways and I did not take the transit visa since I have a valid H1b visa on my passport. My travel agent also confirmed that and I checked on the UK consulate website - according to that too if you have a valid uS visa, you do not need a transit visa. I am not very sure about AP though.

Topic: There is a reason for LUD on an already approved 140, check here

In my case the LUD was on an I-140 that I do not want to use (with later PD). What about cases like that? Don't mean to go against your theory, but my lawyer seemed to think it was for storage purposes, but who knows! I just hope my LUD on a 2006 PD is not to request visa #. I would much rather use my 2005 RIR I-140.

Yes I did get all of my receipts on Aug30. When I called NSC last week, they said it has been with an officer as of Nov26th. May be I am the unlucky one whose AP the officer forgot to look at! Or forgot to update online.
