For many of us who applied between July 2001 & July 2002 (approx), our LC's were sent to the infamous "backlog processing center". LC got approved early 2007!
Applied 485: June 2007.
Namecheck cleared early September.
485 Approved: May 9, 2008.
For those of you waiting - look at it like this: you are just postponing the celebration party :) Let me leave you guys with a joke:
A rabbi, a Hindu and a lawyer were driving late at night in the country when their car broke down. They set out to find help, and came to a farm-house. The farmer there explained that he had only two extra beds, and therefore one of the three men would have to sleep in the barn with the animals.
The rabbi said he would sleep in the barn and let the other two have the beds.
Ten minutes after the rabbi left, there was a knock on the bedroom door. The rabbi entered exclaiming, "I can't sleep in the barn, there is a pig in there. It's against my religion to sleep with a pig!"
The Hindu said he would sleep in the barn, since he has no religious problem with pigs.
However, about five minutes later, the Hindu burst through the bedroom door saying "There's a cow in the barn! I just can't sleep in the same room as a cow----it's against my religion!"
The lawyer, anxious to get some sleep, said he would go to the barn, since he had no problem with animals.
In two minutes, the bedroom door burst open,
and the pig and the cow entered.... |

First good news: I got the Welcome New PR notice. Assuming 485's approved.
Couple of weeks back I filed for renewal of EAD/AP. Does anyone have experience canceling the appilactions and getting the money back? |
Topic: Priority Date BLANK on I-485 receipt.
On my I-485 receipt notice, the priority date field is blank. Once, during a conversation with a TSC IO, I asked her if she knew my priority date (Dec 2001). She said she couldn't tell, based on the information she had in front of her, and she needed the I-140 receipt notice number!
Question: Is this field blank for most of you folks? Should I be concerned? (I applied for 485 AFTER 140 got approved) |

If US needs people, it finds a way to retain them. There's EB1 for the talented folks, thus US is in absolutely no danger of loosing talent. US needed software engineers between 1999-2001, most of my friends who applied in that timeframe got gc's within a year or two, incl EB3. Sometime back I think they needed nurses, so USCIS had expedited processing for nurses. Some employers like nasa require folks to have gc's, I've had friends who got their gc's in months, even in EB2/3 categories.
If you look this whole thing from the point of view of incentives - it starts to make sense. Right now for most EB2/3 folks, employers have just enough interest in making sure that they can show up at work everyday - thus we have schemes like H1-B extension, EAD, etc. Try to rationalize these devices from any other angle - they start to look ludicrous. If H1 is for 6 years, what's the point of allowing one to extend it? Why do we really need to renew EAD every year? What is Advanced Parole? Don't make any sense!
And what exactly is this stupid diversity thing? An Indian and a Japanese came to the US in 2000. The Japanese got gc in 2001, the Indian will get it in 2010. How exactly did the diversity of US improve? Rather, if the Indian got gc in 2001, by 2006 he'd have become a citizen and left the US to settle in India knowing that he could come back anytime - as many of my citizen friends are doing these days. Now that would definitely do good for US's diversity.
In short, there's not much incentive right now for USCIS in handing gc's to EB2/3 categories. So USCIS just works to satisfy a set of statistical goals so as to avoid any huge backlash. But if you look at the current process from America's point of view - it makes a lot of sense. |

Similar story... 2001 PD, June 2007 RD, my NC got cleared early September, everything clear on case, since then it is "waiting for visa number". Recently a whole bunch of June filers got approved - that gave me false hope. Also noticed that for most of the June filers who got approved, their NC cleared less than 15 days prior to getting approval.
When you can't explain, you theorize. So here's what I think happened: You probably noticed that since Oct, TSC approved cases in chronological order of RD. They started with 2006 RDs and moved upto 2007 June. Early December I guess there TSC bosses said it's ok to approve June filers. Normally when NC clearance is received at USCIS, the clerk assigns the case to a Queue (where our cases are right now). But early December, when NC clearance for a June filer was received, the clerks just assigned them directly to Adjudicating Officers who assigned visas and stamped their approval. Given the huge number of applicants who filed in June, this quickly exhausted a huge chunk of EB2 visas, before even someone got a chance to touch the "Queue".
I believe the current retrogression is somewhat politically motivated in that USCIS has other priorities at hand. You must have realized by now that EB2/3 categories are the last priority for USCIS. Family based categories receive high priority since they are filed by citizens. EB1B - truly assets to the nation - high caliber individuals. EB1C - somewhat shady, but at least somehow they managed to get the corporations to stand up for them and proclaim that they are valuable - all the power to them. EB2/3 - we have no one to stand up for us, unless we belong to an area that is perceived to be in high demand as a result of corporate lobbying. So for these cases, USCIS works just to satisfy a set of statistical goals - like approval of a fixed percentage within a certain time - fairness doesn't have a place here.
But life didn't exactly owe us a debt of fairness in the first place - did it? |

I think USCIS can provide a far better service by stating a timeline and STICKING to that, so that we can set our expectations and plan accordingly. It's the randomness that throws me off. That's the real issue. Personally, I think the country quota is rational. |
Topic: Approved, but no visa yet.....weird situation.....help please.
I have heard similar stories of late. Looks like there's something going on with visa numbers. A lot of us with current priority dates and cleared namecheck are waiting for this elusive visa numbers. Most recent Indian approvals are old cases that were assigned visa numbers in the past, so I can safely conclude that for India they haven't issued these visa numbers in the new year. But I do see approvals of ROW folks who filed in June/July. Not sure what causes this discrepancy. Have they requested visa numbers for some countries and not for others?
Anyways, you don't need to worry too much. Looks like everything else on your case is clear, so approval should come pretty soon.
BTW, is there anyone else with CURRENT priority date "waiting for visa number" for approval? |
