Topic: Avoid the mistake.

If I were in your place I would find the phone number of the local tax office or even better go there personally and ask the people there. Posting on a forum such as this is likely and indeed has raised differing opinions. It is only the middle of March you have time to actually go and ask an IRS represenatative personally and their advice will be free of charge.

Since you are in a university setting you could start with your international office who can direct you to sources of useful information in such instances if you feel intimidated by the IRS.

The reply you are so pleased with suggests you could become current shortly but you need to keep this all in perspective. My priority date was current for 8 months before my case was approved. I sincerely hope this does not happen to you assuming your priority date comes current but wanted to emphasize that nothing at USCIS is as it might appear. The process works in mysterious ways.

I agree with LRIndy too! Please take a moment to fill out a profile, it can be very helpful to other members and most importantly to you so people can give you educated answers if you have questions.

I am only sure in the sense that I submitted the I864 according to instructions I was provided with and my application was approved at the beginning of 2009. It is a very simple form and it does not hurt to include it whatever opinions might be.

Thankfully my father had good insurance that covered all hospital costs, cremation etc. I think mum might have ended making a little bit of a profit since the exchange rate altered at a good time. Dad would have loved that!!
My parents got their insurance via their bank, do any of the Indian banks offer such additional services, might be worth investigating.

Good find. Can you share the premium you paid for regular insurance for each person for 6 months? Not to be skeptic but it looks too good to be true. Even seasoned insurance companies would not touch pre-ex conditions with a 10 foot pole. Its surprising how a relatively unknown travel insurance company can guarantee upto 100k coverage for pre-ex conditions. I would be the happiest to know it is true but can someone please add their testimonials for this provider.



100K coverage is not a lot of money. My father spent 8 hours in an ICU on the day he died here in the US and the bill was $30,000. I know nothing about the provider since my parents came here on UK based insurance company but just wanted to illustrate that the sum being covered might be not nearly enough if there was a problem.

Dear trackitt members/Gurus

My I-140 application got approved recently (EB2 category). Based on that I am planning to file I-485 for me and my wife. I have following questions/concern. I would appreciate your valuable suggestion/answers for the following questions

1. Can I send my wife's 485 application to same service center (TX in my case) or will I have to send it to somewhere else as she is the dependent ( I am not sure if she falls under family based or employment based category).
You can send your wife's application to the same location since the cases are linked, you primary, her derivative. She is not family based.

2. Do i need to submit affidavit of support for my wife (She is in US and working in H-1B visa). If yes which form I-864 or I-134
I submitted an affidavit of support as I was advised to do so by my international office. Employment based applicants use I 864.

3. My wife has country of birth whose dates are not current but mine are (I am from Nepal). Can she be charged based on availability of dates for me. Do i need to mention any thing in her I-485 application so that she will approved based on availability of my dates.
You are the primary so if your priority date is current then both of your applications fall under that visa availability date.

4. If we have the same filing location, can I send mine and my wife's application in the same envelope.
Yes you can. However, put all your forms and evidence in one pile of papers and hers in a separate one. Each application should have its own checklist of what is included clipped to it.

my h1 extension got denied recently after jan 08 memo and my daughter is held up in India.



If that is the case then if she is still under 21 when your priority date becomes current you can apply for her to undergo consular processing.

As a parent of a child on an F1, we do not allow him to leave the country since it is highly likely that he would not get a visa stamp allowing him to return. The chances of your daughter being issued a visitors visa unless she has a full life in her home country is unlikely. The immigration service would almost certainly see her as a possible defaulter on the visa status.

With regard to adjustment of status application, an individual has to be in the USA to benefit from this. If they are overseas it will be via consular processing, however, your priority date has to be current for either possibility.

Do you have an H1 visa approval? We need some feedback. If you have then you can leave the country get a stamp in your passport and then can apply for an H4 for your daughter assuming she is under 21. Your daughters age is very important. Another thing forum members need feedback on so they can assist you more knowledgably.

Do not be perturbed by your lawyers outburst, this is your case there is nothing wrong with wanting to know answers. It sounds as if they just want to keep control over your case so they can justify their fee.

Since it might only take a few minutes for an immigration officer to look at a case and them make a decision maybe the post decision activity letter is automatically generated and then the approval one was generated in the same working day for the officer.

You really need to follow up to keep your sanity. If you do not want to go the USCIS office, how about contacting your local congressman or senators office and asking them to act on your behalf and find out what exactly is going on. You can find their contact information online or just call them and start things rolling.

I really do hope you can find out sooner rather than later.

Check the dates on each notice carefully. The one saying they have reopened the case could have preceded the approval one in reality but they just happen to have been dispatched on the same day.

The online status really cannot be 100% relied upon and can take time to catch up.

If I were in your place I would be booking an infopass appointment and going to the nearest USCIS office and speaking directly to a human being. I do not know if it will help but at least you will feel as if you are doing something about your dilemma.

I agree that being overqualified is not an issue. Never said it was, I was intimating that if an individual qualifies for a green card in the most esteemed employment based level then applying for a job that is lower on the scale might indicate that the original poster is a beneficiiary of how messed up the employment based process can be, i.e. not everything is exactly as it might appear and that EB1 is really not that difficult to get approved after all.

Your understanding is accurate. They do have an employee who is hoping they can get a labor certification so that they can then go ahead and start on the road to their green card. Anyone can apply and if there is someone who is eminently qualified then the labor cert has a good chance of being rejected and that individuals green card dreams bite the dust.

If you have a green card via EB1 it would suggest that you are over qualified for this advertised position as it is not as far up the 'food chain' in the employment based ladder as it does require labor cert??? Not sure then how this job can be an advancement for you, as you suggest?

If you do not get approval of your EAD after 90 days you can take an infopass appointment at your nearest office and they will submit a message to the processing office to get it approved promptly.

It is hard to know what to suggest. My priority date was current for eight of twelve months before my case was approved. Having your priority date current does not mean a great deal unless someone picks your case up for review.

You could try contacting your local senator or congressman and ask if they can find out if there is any reason your case is not being reviewed. I am not sure it helps but is surely worth trying.

The workings of the USCIS are something a mystery. You may have to wait for five more months or it might be approved tomorrow it is very difficult to predict.

However, bing75 you should be appreciative of how short your immigration process is likely to be. Posting such comments on this forum where hundreds of people have been mired in the madness for up to a decade and longer is going to draw fire so keep your head down.

Since there is no field for receipt # I am assuming they do not need a receipt number. If you have an A# then fill that in, they are asking for that if you have one.

This is only possible if the role they play would be voluntary regardless of who performs it. Otherwise it can be construed as taking a job that could be held down by someone who is eligible to work in the US. The definition of volunteer is pretty narrow.
