She asked about my history in the country, criminal past, etc. At several instances, I got the feeling she's completely unfamiliar with my case and has never read it before. Either way, the interview lasted about half an hour, and then she informed me that my fingerprints didn't go through, even though I took them twice in less than a year. From my research, I was expecting her to say that she'll send an RFE for a police clearance report or something like that, but instead she said that I'll "probably" be getting another appointment notice for prints. I told her that this would be my third time and what if they didn't pass the third time? She seemed not to like the question and her answer was "I don't know!" All in all, I had high hopes today's interview would be the end of this process for me, but clearly not. It wasn't the most pleasant experience in the world, especially considering lots of interview reports on this site seem to indicate a pleasant one. I guess the waiting game continues now... ball back in their court. Sigh!

Topic: What to do if second finger print still fails?

Hey guys... I'm kinda confused about something. Two weeks ago I had an interview appointment and things went well except that apparently my 2nd FPs failed. On Friday, I got a letter from the IO requesting that I send a police clearance letter from LA county sheriff's department and/or all local law enforcement agencies that had jurisdiction over where I've lived in the last 5 years. I went to the local police department and showed the letter to the officer there and he gave me a Criminal history letter, unsealed, that basically says I haven't been arrested for anything. It says on it that it "may not be reflective of a complete criminal history check" I paid $25 for this letter. Is this sufficient enough? I didn't fill out any forms and all the officer checked was the letter and my driver's license and put the info in the computer. Does the IO mean something else or is this fine?

Topic: LUDs after interview?

Hey guys,

I was wondering if any of you who have had interviews got any LUDs the day of or a couple of days after the interview. I'm expecting an RFE after the interview, but two days later and not even a soft LUD. Does that mean nobody has touched my file since the interview? The IO said that they'll probably be sending out an RFE within the week. What do you guys think?

Topic: Fingerprinting for a third time?

Hey guys,

Last year, when I first sent in my AOS application, I of course did the first fingerprinting session in July. About two months later, I had to go again because my first set of prints didn't turn out to be good enough. After that, I didn't hear anything and assumed the prints were fine... until December when I got notice that my 485 case was transferred to NBC for interview. Today I had my interview, and the IO told me that my prints weren't good enough. Now from what I read, I expected the next step to be an RFE for a police clearance, which I can get rather quickly with no problems at all, but instead she told me that I'll probably be getting another fingerprinting appointment in the mail. I'm really frustrated because this could mean another 2 month delay at least, and what if those don't work out, then the delay will be a lot longer.

I've never heard of someone fingerprinting three times in one year. Is it possible she's wrong?

I was definately out of status before I applied. I was grandfathered by 245i and that's how I'm able to adjust. I'm not currently employed so the only employer I'm dealing with is the one who's sponsoring me. I'm in eb2 category.

Hey guys, I had a question about what exactly is required of me as far as documents to bring to the interview. My case is employment based, so obviously my sponsor is a company. The plan was for me to start working once I got my Green card, and now I'm on EAD status and I was out of status before my EAD was approved. My I-140 has already been approved and my PD is June 4, 2008.

1. I'm asked to bring letters from my employer, verifying current pay rate and average weekly hours, and pay stubs for last two months. Obviously I don't have that.

2. Evidence of my sponsor's US Citizenship or lawful permanent resident status. Who exactly do they mean by that?

3. Petitioner's birth certificate and petitioner's evidence of US citizenship or lawful permanent residence. Again, who do they mean?

These three things are throwing me off a bit. Any help would be great guys. And I really don't know what to make of my PD. Is that a good date, or is it not current? what exactly does this date show?

Hey guys...

Out of nowhere at 7:00 pm today I got the magical CPO e-mail. I'm fairly certain this had absolutely nothing to do with the infopass appointment and I was getting set to do an expedite fax tomorrow, so that's unnecessary now. I wanna wish you guys the best with this thing and keep your heads up. It really is amazing how right when you feel down and out it comes out of nowhere.

I can't believe I'll finally be able to drive a car and work. 10 years after all my classmates did it I'm finally gonna do it as well :)

Well here's the report of my lovely infopass appointment. I went in there and told the lady I'm way over the 90 day limit. She called the service center and told me that they're backlogged. I asked her to put in a request for an interim EAD and the attitude started, telling me that they're backlogged and they don't accept those requests anymore. I pulled out the memo to show her and next thing I know the lady is yelling at me: "I KNOW HOW TO DO MY JOB... THEY DON'T DO THAT ANYMORE THAT PAPER IS OLD... I KNOW WHAT I'M DOING." So given that I was in the immigration building, I bit my tongue and escaped before any more damage was done.

It was quite the situation! Ugh!!

So I got home and called the service center just to see if I get anywhere with them, and I asked the lady for a fax number for NSC so I can do an expedite request, and she told me they don't give out fax numbers and they don't accept faxes anymore. She said the only way to expedite is to tell her if my case falls under one of several categories she listed, like extreme hardship or something like that, and I told her that it didn't because I knew she was BSing me. I'm gonna try to fax a letter and the job offer to see what happens.

Well I'm going for an infopass this week, and I am in a very similar situation as you. My received date is June 4, so obviously it's over the 90 day limit, and I'm going to ask for an interim EAD. What I think you should have done, and what I'm going to do, is take with me the memo that says that field offices no longer issue interim EADs as of 2006, but can send a request on behalf of the applicant during an infopass to the service center asking the SC to issue the interim EAD. So basically, the law is that the field office can't do it anymore, but the service center can and the infopass session is supposed to put in the request for you. I'll post back after I go and see what happens.

Thanks for the update mray, and I'm shocked that now you need a reason for them to give you an interim EAD! I figured that would be your right since they didn't meet the 90 day deadline. Let's hope it works out!

Sandy I think the LUD is an indication that they received your documents but I can't say for sure if it's a sign that something will be changing soon. Keep your fingers crossed I guess!

I'll be going to the Los Angeles field office on Monday, and I'll report back what kind of luck I have. I desperately need the EAD to get my driver's license and to start working so hopefully they'll have a heart and won't stand in my way. Also, if any of you guys get any further updates, please inform the rest of us on this thread and let's try to make this one a valuable source of information for all those who've passed the 90 day mark!

Topic: The 100+ Club

Hey guys...

I have a question about the expedite request that usually seems to work for most people. What kinds of documents do you submit to prove hardship? I'm unemployed and have credit card debt. I have very little money in my account and I have been out of status for years and am now adjusting. I don't have a driver's license and I need to the EAD to get that and to finally start working. Is this enough of a reason? Do I need to prove all of this, or just explaining it is enough?

My received date is June 4th, so I'm on day 106, and there have been no LUDs on my case at all since FP. I called NSC several times and they wouldn't open a service request because my case is within the processing time frame. I hear it's possible to make a request for an interim EAD when you go to infopass, and they will direct that request to the service center, so I made an infopass appointment to do that this coming Tuesday. Have any of you tried the interim EAD approach?

What exactly did you fax them? Also, the woman on the phone told me they no longer offer interim EADs, so what exactly is the truth? I'm in California btw, but my application is at NSC.

It sounds from all the LUDs that you're getting that your application is nearing approval. At least in similar cases I've heard of that's what usually happens after several LUDs in succession. I hope that's the case with you!

Topic: Couldn't open a service request!!! What's going on at USCIS?

Well I tried again today, twice, and I'm getting nowhere.

The first time I called today, the lady agrees that it's been longer than the 75 day normal processing time and directs me somewhere else for the service request. The lady there, however, decides that I'm within normal processing time and refuses to open a service request. Hang up, try again!

The next time I speak to a guy and explain to him what I'd like to do. At first he tells me to allow the 75 day normal processing time to be met before I do a service request. I then explain to him that it's been 91 days and he concedes that his math isn't very good! ha ha! He says he'll try to open a service request, but then tells me that because the center is processing March 31st cases, my case doesn't meet the criteria of being outside the processing times. Now March 31st was 155 days ago, so is it 155 days, or is it 75 days? This is seriously ridiculous!

How are some of you guys opening service requests with people like this on the other end of the line?

Well today is my 90th day since the received date of my EAD application. The last update was on the day of my biometrics appointment, and no LUDs since then. I figured I'd call USCIS and put in a service request on this joyous occasion, and that's what I tried to do. The lady who answered the phone kept insisting that it's been only 65 days, even when I tried to explain that Sept 2nd - June 4th is 90 days. Anyways I asked her if I could open a service request and she told me to wait a month because it's within normal processing times.

As you can imagine I hung up rather frustrated! What's a guy supposed to do to get this process moving?
